What Insurance Covers Failed Software Implementations?

A failed software implementation can lead to a professional-services claim if a customer alleges that configuration, migration, integration, or deployment work was performed negligently and caused financial loss. Technology E&O or professional liability is the relevant line to review. Texas DOI describes professional liability as covering claims arising from professional services, including failures to provide them, but the actual policy must include the implementation services in its definition.

A customer’s demand for damages is not the same as the vendor’s cost to complete unfinished work. Policies can distinguish covered liability from contractual promises, refunds, service credits, and the expense to correct or replace deficient work. The contract’s acceptance criteria, change requests, data-migration responsibilities, and limitation-of-liability clauses can affect both the claim and how policy exclusions apply.

Check whether integration, migration, configuration, hosting, and third-party software are covered services. Review contractual-liability and re-performance exclusions, subcontractor wording, retroactive date, reporting obligations, and defense-cost erosion. Ask the broker to compare the relevant contract obligations with the policy wording and identify any implementation-specific sublimit or endorsement.
