What Insurance Covers a Missed Professional Deadline?
Professional liability or E&O may respond when a client claims a missed deadline in covered professional services caused financial harm. Contractual penalties, delay guarantees, and the policy’s claims-made timing may limit coverage.
A missed deadline can lead to an E&O claim when the customer alleges that a professional service was negligently performed or not completed and seeks damages for resulting financial loss. The Texas Department of Insurance describes professional liability as covering claims for damages arising from professional services or failure to provide them. A deadline dispute still must fit the policy’s grant; simply losing a contract or owing a late fee does not establish insured damages.
The contract may promise a particular completion date, service level, or liquidated-damages amount. Policies can treat contractual liability, refunds, service credits, or guarantees differently from ordinary negligence allegations. Claims-made reporting provisions also matter: Texas DOI explains that claims-made coverage generally requires a claim to be made and reported during the applicable policy period unless special coverage is arranged.
Check the professional-services definition, contract and delay exclusions, treatment of liquidated damages and service credits, retroactive date, and notice requirements. Tell the insurer about demand letters or circumstances before renewal, and ask how defense expenses apply to limits. Keep project schedules, change orders, client notices, and acceptance records.
