Does Professional Liability Cover Negligence?

Often, a covered negligence allegation tied to scheduled professional services is the kind of claim E&O is intended to address.

Professional liability is commonly used when a client alleges that a professional failed to meet the expected standard of service and caused loss. III lists negligence among claims professional liability may address that general liability does not. That does not mean every allegation is covered: the policy must cover the insured’s specific services, the claimant and alleged conduct must fit the insuring agreement, and exclusions or notice conditions may apply. A specimen form defines covered claims by reference to wrongful acts in providing or failing to provide professional services. Check the retroactive date, prior-knowledge exclusion, definition of damages, consent-to-settle terms, and whether the policy is claims-made before assuming a negligence demand qualifies.

The insurer may examine when the act occurred, whether it was known before inception, and whether notice met the deadline. Save client communications and report circumstances promptly under the policy instructions.
