Does Professional Liability Cover Missed Deadlines?
A missed deadline may lead to a covered professional-negligence claim if it concerns insured services and causes covered loss.
A delay is not covered simply because a contract included a delivery date. The relevant questions are whether the client alleges an error or omission in scheduled services, whether there is covered loss, and whether an exclusion or contractual limitation applies. The Hartford describes missed technology product-development deadlines as an example of a possible Tech E&O claim; that is its product description, not a promise for all policies. Review any service-level agreement, liquidated-damages clause, and performance guarantee. For claims-made coverage, check when a claim must be made and reported, plus the retroactive date. Ask whether delay-related consequential loss is covered and whether defense expenses reduce the limit.
A quote may distinguish the cost to complete delayed work from a client’s consequential loss. Ask how service credits and liquidated damages are treated, then compare the answer with delivery promises.
