Does Media Liability Cover False Advertising?

It depends. A form may cover some advertising-related allegations while excluding deceptive trade practices, misleading ads, investigations, or regulatory enforcement.

Advertising-related coverage varies sharply by wording. In the reviewed Hiscox specimen, media coverage can arise from advertising professional services, but exclusions bar claims based on false, deceptive, or unfair trade practices and deceptive or misleading advertising. The exclusion preserves a narrow exception for specified trademark infringement or false-designation claims. This example shows that an advertising injury label does not resolve which false-advertising theories are covered.

The FTC explains that whether an advertising practice is deceptive depends on facts and context; its Endorsement Guides are guidance rather than law, while the FTC Act is a legal basis for enforcement. Insurance treatment is a separate question from whether a marketing practice complies with law. A policy may also exclude government investigations or enforcement proceedings.

Review the exact false-advertising exclusion and exceptions, investigation costs, restitution, penalties, and regulatory proceeding terms. If endorsements or sponsored content are central to your work, compare the actual form with your procedures and seek clarification in writing.
