Does General Liability Cover Lawsuits?

Often, if a suit alleges covered bodily injury, property damage, or a defined Coverage B offense. The insurer’s duty to defend is limited by the policy wording and claim facts.

A CGL policy can require the insurer to defend a suit that alleges covered liability, but the defense obligation is tied to the policy’s insuring agreements and exclusions. The ISO form sets out a defense duty for covered Coverage A or B suits and describes when that duty ends. A lawsuit involving only unpaid invoices, professional advice, employment practices, an auto accident, or a cyber event may not fall within CGL even though it names the business.

Send suit papers and demands to the insurer promptly under the notice conditions, and preserve the pleadings and relevant records. Compare the allegations with the covered injury, damage, and offense definitions, then review defense conditions, other insurance, limits, and endorsements. The title of the lawsuit does not establish coverage, and the actual policy and facts determine whether a defense is owed.
