EPLI vs. Workers’ Compensation: How Do They Differ?

EPLI addresses certain employment-practices liability claims; workers’ compensation generally provides statutory benefits for job-related injury or illness.

EPLI and workers’ compensation address different problems. EPLI may respond to specified allegations such as discrimination or wrongful termination, while workers’ compensation systems provide state-defined benefits for covered work-related injuries or illnesses. Triple-I notes that workers’ compensation-law claims are often excluded from EPLI, and NAIC describes workers’ compensation as a state-regulated system whose requirements and administration vary. One policy does not replace the other. Check the states where employees work, applicable workers’ compensation requirements, the EPLI exclusions, and any employer-liability coverage. If an incident includes both an injury and alleged retaliation or discrimination, the facts and separate policy wording can matter.
