Does D&O Cover Employment Claims?
Sometimes, but employment claims may be excluded from D&O or covered only by an EPLI grant or endorsement.
Leadership may be named in employment disputes, yet D&O does not automatically provide broad workplace coverage. Triple-I notes employment and HR issues among potential claims against leaders and says EPL can be added to D&O forms or purchased separately. The Travelers specimen includes a specific exclusion for many employment-related wrongful-act claims. Compare the employment exclusion, any insured-person exception, defense and limit structure, and whether EPLI is a separate policy or shared-limit section. Check treatment of applicants, employees, third parties, wage claims, and claims against individual managers before relying on D&O.
Employment allegations can name executives personally, but the policy may exclude employment-related wrongful acts or cover them only through EPLI. Side A/B can be relevant to an insured person’s covered management conduct; Side C is not a substitute for an employment insuring agreement. An EPLI section may have separate definitions, retentions, and limits, while an insured-versus-insured clause may affect a company’s claim against its leader. Compare who is an insured, whether applicants and former employees are included, and how wage-and-hour or benefit-plan allegations are handled. Read the D&O exclusion together with any EPLI form or endorsement.
