Does FERPA tell you which insurance a school or vendor should buy?
The Department of Education’s FERPA guidance explains when a school-official exception may allow a covered institution to disclose education records to an outside provider and what control and use conditions apply. It does not define an insurance policy’s coverage; describe the data and service to the broker, then review the actual forms.[5][1]
First confirm whether the institution and records fit the cited FERPA guidance. The Department says covered institutions include public schools, districts, and postsecondary institutions receiving Department-administered funds; private and parochial K–12 schools generally do not receive such funding. Keep “generally” and check the particular institution and record rather than assuming the same privacy rules apply to every school.[4]
