Minnesota's source-choice rule generally prevents an insurer from naming the E&O carrier an agent must use. It does not bar the insurer from requiring E&O or setting coverage criteria; ask which limit, form, and deductible standards are mandatory for your appointment. 1
Check the Captive or Premium-Funding Exception
The source-choice rule does not apply to a captive producer writing 80% or more of gross annual business for the insurer and its subsidiaries, an insurer employee, or coverage whose premium the insurer or affiliated broker-dealer pays or contributes toward. Confirm which category the insurer relies on before disputing a carrier restriction. 1
Match the Policy to the Licensed Entity
Minnesota requires a business entity acting as an insurance producer to hold a producer license and designate an individually licensed producer responsible for compliance. Ask the broker to confirm whether the E&O policy names the entity and the responsible individuals whose work the carrier expects it to cover. 2
