Key Differences Between Cowbell and Founder Shield
AI Output Liability and Cyber Incidents
An established business is using generative AI to answer customer questions and prepare marketing material. Founder Shield's named AI product addresses third-party allegations arising from outputs, including errors, infringement and unauthorized data disclosure. Its published scope makes a practical distinction: an inaccurate answer or infringing image can create a liability question even without a hacker accessing the network. Ask which deployed tools and uses the proposed application will describe, and which output-related allegations the form actually covers. 36
Cowbell Prime One describes AI incidents involving unauthorized access, misuse or manipulation leading to data exposure or system compromise. It is positioned for advanced digital exposures, typically businesses with at least $250 million annual revenue, so it is not a universal small-business AI alternative. Ask the broker whether this program fits the company and how its security-event trigger would treat the same customer-facing tools. An AI feature in a cyber overview does not establish coverage for every erroneous or infringing output. 14
Founder Shield's standalone AI page excludes standard cyberattacks. That leaves a separate cyber-insurance decision, which its broader brokerage can also address. Cowbell's cyber programs can likewise be considered as one part of the business's insurance program. Request a written comparison using two distinct situations: an AI output discloses protected information, and an attacker compromises the system containing that information. 36 33 14
AI Product Sales and Eligibility
Founder Shield markets a standalone generative-AI liability product for US businesses using AI in their operations, with revenue up to $10 billion. Its page excludes companies selling AI products, standard cyberattacks and intentional misuse. 36
If the business later sells an AI product to customers, it should not assume this particular deployer product follows that change. Founder Shield's broader E&O and specialty catalogue is a separate placement route to discuss; exclusion from the named AI product does not mean exclusion from all of its brokerage services. Its business-change guidance specifically asks clients to report new products, business-model changes and new territories. That discussion belongs in the launch plan. 36 33 41
Cowbell Prime Tech combines technology E&O with cyber for eligible technology businesses. It creates a relevant question about selling software, but the overview does not establish acceptance of this AI product or every AI-related allegation. Submit the actual functionality, users and contractual responsibilities and obtain the applicable form and exclusions. Moving from using software to selling it changes the insured service, not merely the application label. 16 41
Defense Costs, Reporting and Policy Forms
The AI product page describes claims-made-and-reported coverage, so the timing of both the claim and its reporting matters. It describes a duty to defend covered claims, with defense spending reducing the available policy limit. Listed risks include AI-output errors, intellectual-property infringement or defamation, data disclosure, bodily injury and property damage. 36
For a business using AI, defense costs that reduce the limit mean the stated limit must cover more than a possible settlement. Ask how defense spending, any retention and reporting deadlines interact, including allegations made near renewal. Founder Shield describes five coverage categories while its linked underwriting partner Testudo describes six, adding AI regulatory violations. Request the exact proposed form rather than assuming the additional agreement appears in every quote. 36 37
Cowbell's product descriptions are also overviews rather than policy wording. Ask for the proposed cyber or Prime Tech sections alongside the AI form, with notice obligations, exclusions and limits identified. If more than one policy might respond to a data-disclosure allegation, have the broker explain the notification and coordination requirements without assuming one claim portal satisfies all insurers. 16 14 43
Insurers, Incident Response and Claims Contacts
Testudo's licensing page expressly says its US entity is a producer that places cover and does not bear risk. Founder Shield is the retail brokerage in this discussion; the proposed insurer or Lloyd's subscribing entities still need to be identified. Cowbell likewise acts as an agency or general agent. Prime One names Chaucer Specialty Insurance Company, but that name should not be generalized to every Cowbell program. 39 24 8 14
Cowbell documents in-house cyber incident-response coordination and security services. Founder Shield documents claims advocacy, a reporting portal and direct-insurer reporting, including support on cyber and management-liability claims. For the business's response plan, identify who handles a live system intrusion and who receives a demand alleging an AI output caused harm. These roles can complement each other; neither advocate nor incident-response panel automatically replaces the issuing insurer's coverage decision. 21 43
Fees, Financing and Midyear Changes
Founder Shield discloses commissions, fees or interest and says charges are disclosed in advance. Its terms also warn that some policies have minimum earned premiums, amounts retained by the insurer after cancellation. If the company changes from AI user to seller midyear, ask what a necessary replacement would cost after those amounts and any financing balance. A new product launch can therefore create a payment decision as well as a coverage decision. 24 41
Cowbell's 2.99% direct-bill card fee and premium-finance arrangements should be included in the comparison, alongside optional security subscriptions. Some training and services are included for a limited period, not permanently free. Request the first-year and renewal cost for the selected insurance and services; avoid comparing an AI-only premium with a combined cyber/technology program. 20 22 16
