A Product Comparison Is Not a Broker Comparison

At-Bay’s platform supports brokers applying for and binding its products. Marsh describes selecting insurers and negotiating terms for clients. Compare an At-Bay offer with the specific insurer and form Marsh proposes, then evaluate the advisory engagement separately. There is no basis here to assume that a particular Marsh team can place At-Bay or that buying a specialist product addresses the rest of the company’s insurance needs. 6 30 36

Customer Remedies Need Wording-Level Review

At-Bay’s technology page describes coding errors, failed implementations, contractual indemnity and service credits issued to settle a claim. Those highlights remain subject to policy terms. Marsh’s professional-liability practice offers risk-transfer design for technology companies. Provide the customer contract and ask how each proposed form treats the promised remedies, rather than assuming every indemnity or service credit is insured. 2 26

Security Operations and Loss Preparation Are Different Work

At-Bay distinguishes Stance access under an Embedded Security Fee from separately purchased managed detection and response. Marsh’s cyber advocates describe preparing claims and proof of loss with insurers and forensic accountants. Ask which tasks are included, what remains with the internal security team and which costs are separate. Neither service description establishes better incident outcomes. 7 22

What to Confirm in Quotes

Request California acceptance, the current legal insurer, contractual-liability wording and total service charges. At-Bay’s 2023 carrier announcement is not enough to identify today’s quote. Also agree on renewal approval: its platform describes rapid and manual routes, while Marsh’s responsibilities depend on the engagement. 11 5 6 31

At-Bay describes Tech E&O as combining professional liability and cyber protection, including coding errors, failed implementations and customer contractual indemnity. It also describes service credits issued to settle a claim as payable damages, subject to policy terms. 2

At-Bay markets cyber coverage for direct and contingent business interruption and system failure, cyber extortion, privacy liability, and financial fraud exposures such as social engineering and invoice manipulation. Specific limits and conditions require the quote and policy. 3

At-Bay markets miscellaneous professional liability (MPL) on a primary basis for businesses of all revenue sizes, with limits up to $5 million and state restrictions. The product page describes claims-made-and-reported coverage, a duty to defend and a tailored definition of professional services. 4

At-Bay advertises excess Cyber and Tech E&O alongside primary coverage. The excess catalogue entry refers to those specialist lines; it does not establish a general commercial umbrella offering. 3,2

Marsh’s Cyber Insurance practice markets brokerage of cyber policies and related analytics products. Marsh McLennan Agency’s cyber page lists solution areas such as cybercrime, extortion and ransomware, media liability, network interruption and privacy regulatory defense costs. The Technology Practice’s data-center service describes programs that can include property damage, equipment breakdown, business interruption, cyber, general liability and surety for power and interconnection obligations. Stratus is marketed as an operational property exchange for digital infrastructure with potential access to up to $10 billion of property capacity on a single placement; at launch it is focused on property, with inland marine, cyber and casualty described as possible later lines. Its Employment Practices page offers EPLI, including endorsements described for firms with more than 4,000 employees and for midsize firms with 250 to 4,000 employees. Its Professional Liability page offers E&O risk-transfer design, including for technology businesses. MMA’s executive and professional liability practice lists D&O, E&O, EPL, commercial crime/fidelity, cyber, fiduciary, media, intellectual property and kidnap-and-ransom among policies it places. Application process

At-Bay describes a broker workflow of completing an application, adjusting limits and retentions, reviewing documents, selecting an effective date, and satisfying contingencies and signature requirements before binding. Brokers can also email submissions to underwriting. An online quote is not itself bound coverage. 6,4

The public Marsh path to speak with a broker is an inquiry, not an online bind. Contact pages ask you to choose an inquiry type, including a sales or RFP route. The business-inquiry page says to complete a form and that a representative will respond within 48 hours; it points existing-policy certificate, billing and policy questions elsewhere. The inquiry page does not display premiums or bind coverage. The 48-hour response time is a company statement, not a binding or service guarantee. 28,29,34

Marsh describes a broker-led placement: identifying insurers for the risk, negotiating coverage and price, and, in core US broking segments, disclosing quotes and premium indications received. It may share incumbent or competing insurer names, pricing objectives, expiring terms, or give an insurer a last look when it believes that is in the client’s interest or the client instructs it. Those market practices are disclosure statements, not a guaranteed outcome or turnaround. 31,30

Access to insurers

At-Bay announced in August 2023 that eligible new E&S Cyber and Tech E&O business would be quoted on At-Bay Specialty Insurance Company paper. That historical announcement does not identify the insurer on a current California quote or establish the issuer for MPL. 11

The current MPL product page does not name its issuing insurer. A September 2023 announcement names United Specialty Company for MPL, but that historical reference is insufficient to establish the current contracting insurer or California placement. 4,13

Marsh and MMA describe access to multiple insurers rather than a single issuing carrier for all business. MMA says it works with a wide variety of carriers. Stratus is a prior-submit exchange in which participating insurers evaluate each risk individually; the page does not name those insurers. Marsh’s compensation and transparency pages say Marsh or affiliates may receive insurer consulting compensation and may own equity interests in certain insurers or reinsurers, with a list on the transparency site. At-Bay lists California P&C and surplus-lines license number 0L73812 for At-Bay Insurance Services LLC. This is a company disclosure, not an independently checked California Department of Insurance record or confirmation that a particular product is available. 5

The reviewed product and licensing pages do not establish current California eligibility for a specific startup, product and issuing insurer. At-Bay warns that products may not be available in every state, and MPL has state restrictions; obtain California placement confirmation through the broker. 5,2,3,4

Marsh markets services in 130 countries. MMA is described as serving middle-market companies in the United States and Canada. Reviewed pages do not publish a product-by-state eligibility schedule, admitted versus surplus-lines map, or a California-only startup program. A California office mention, if any, would not by itself establish that a given policy can be issued to a California company.
