Tech E&O vs Professional Liability: Is There a Difference?
Tech E&O is a specialized professional-liability approach for technology products or services; a general professional E&O form may schedule different work.
The labels overlap: California DOI says professional liability can include E&O for high-tech businesses, while insurers market technology E&O products for technology services and products. The Hartford lists software, consulting, integration, and hosting businesses among examples of its technology product’s audience. Coalition’s North American service page describes Tech E&O as an optional endorsement to its cyber coverage. These are product-specific descriptions, not an industry-wide definition. Identify whether the form is miscellaneous professional E&O, Tech E&O, or a package; compare scheduled services, product-failure and security terms, exclusions, retroactive dates, and reporting rules. Make sure SaaS, implementation, consulting, and custom development appear accurately in the application.
Tech E&O may be an endorsement, separate policy, or professional-liability form depending on insurer. Confirm which contract issues and whether its limit is shared with cyber coverage.
