Does Product Liability Cover Warning Defects?

It may cover a third-party injury claim alleging inadequate instructions or warnings, subject to policy terms and exclusions.

A warning or instruction claim alleges that a label, manual, or other communication failed to explain a product risk or safe use. The Insurance Information Institute flags directions, warnings, and marketing as potential causes of product-liability exposure. An illustrative ISO CGL form defines “your product” to include failures to provide warnings or instructions; that definition alone does not exclude injury claims, which remain subject to the coverage grant and other exclusions.

Ask the insurer to review the actual wording for your product, warning practices, and territory. Check exclusions for failure to perform, instructions or warnings, and product recall, as well as any applicable endorsement. Keep product labels, manuals, and revision histories available when applying or responding to a claim. For a warning claim, preserve versions of labels and instructions, translations, and product-change records. Those materials help identify which policy and product version could be implicated; they do not expand coverage.
