Does Media Liability Cover Podcasts?
A policy may include podcasting in its media or advertising definitions, but confirm that the insured’s podcast activities and claims fit the wording.
Podcasting can involve recorded speech, music, guest interviews, advertising, streaming, and distribution through third-party platforms. In the reviewed Hiscox specimen, “advertising” includes podcasting among ways professional services may be promoted, while media content includes language, music, and other communications. Those definitions show how a form may address podcasts, but they are not universal terms.
Coverage for a defamation or music-rights demand depends on the insuring agreement, who is insured, connection to covered services, exclusions, and claim timing. A podcast produced for a client or containing guest- or listener-supplied material may raise separate contract, ownership, or third-party-content issues.
Provide the insurer with your format, distribution channels, ad insertions, licensing arrangements, guest releases, and whether you produce shows for clients. Check treatment of music and clips, guests, sponsorships, client work, defense-cost limits, and retroactive dates in the quote and endorsements.
