Is IP Insurance Relevant for Technology Companies?

It can be relevant when technology products or services create patent, copyright, trademark, or trade-secret disputes. Confirm which activities and rights the policy includes.

Technology companies may combine software copyrights, product patents, brand marks, licensed components, and confidential technical information. The NAIC identifies certain copyright, trademark, and patent infringement claims as examples of IP insurance, but it does not define a complete technology policy. CFC's application asks for product and territory information and inventories of rights, illustrating the detail a specialist insurer may request.

Describe whether you build hardware, sell software, provide cloud services, license technology, integrate third-party systems, or perform consulting. Identify the legal entities that own or use each right and where the products are sold. Ask whether the quote includes defense, enforcement, and contractual indemnity, then request the applicable wording. Compare technology E&O and cyber terms, including IP exclusions, triggers, defense-cost treatment, and limits. A broad “technology company” category does not itself insure every technology-related dispute, so reconcile the policy schedule with actual operations.
