Does Media Liability Cover Intellectual Property?

A media liability form may cover specified content-related claims, subject to its definitions and exclusions. It is not general insurance for all IP rights or enforcement costs.

Media liability policies often define covered claims by reference to media activities and allegations involving content. A Hiscox specimen form, for example, lists specified copyright and trademark allegations in its grant, while excluding patent and trade-secret infringement and some software copyright claims. This specimen illustrates how a media form can include and exclude different IP allegations; it does not establish wording for another insurer or an issued policy.

Check the definition of media activities, covered offenses, eligible content, and exclusions against the actual allegation. Ask how the form treats website publishing, advertising, customer content, software, AI-generated material, and enforcement of your own rights. Confirm defense duties, settlement consent, sublimits, and whether the claim must arise from defined media work. A dedicated IP policy may address different rights or pursue an infringer. Request the full form and endorsements; the phrase “media liability” does not establish protection for every copyright, trademark, patent, or trade-secret dispute.
