Does Business Insurance Cover Intellectual Property?

A business policy may cover a particular IP claim, but general business insurance does not automatically include broad IP protection. Check each policy's wording and endorsements.

Business insurance can mean a package of separate policies. The NAIC explains that a business owners policy typically bundles property, business interruption, and liability coverage, while it lists IP infringement insurance as another coverage type. This distinction matters: buying a BOP or commercial package does not by itself show that patent, trademark, copyright, or trade-secret disputes are covered.

Review each policy separately. General liability may have a narrow personal and advertising injury grant with IP exclusions and exceptions; media or cyber wording can address certain content claims under defined conditions; professional liability can respond to claims tied to covered services. Dedicated IP products may separately offer defense or enforcement. Ask the broker to point to the specific coverage part, endorsement, and limit that applies to your concern. Compare exclusions, claim triggers, territory, defense-cost erosion, and coordination language. Do not rely on a certificate or broad package name to expand policy terms.
