What Are Some EPLI Claim Examples?

Common allegations include discrimination, harassment, retaliation, wrongful termination, and hiring or promotion disputes; any scenario is policy-dependent.

Illustrative hypothetical: an applicant alleges that a hiring decision was discriminatory, or a former employee alleges retaliation after reporting harassment. EPLI forms commonly list these types of allegations, but a scenario is not a promise that an insurer would pay. The policy must cover the claimant, alleged act, and claim as defined, and notice must meet its timing rules. Wage-and-hour disputes, criminal acts, uninsurable damages, and computer-breach privacy claims may be excluded or handled elsewhere. When reviewing a real demand, preserve relevant records, follow the policy’s prompt notice instructions, and ask the insurer how defense counsel, settlement consent, retentions, and limits work under the issued form.
