Does Commercial Umbrella Cover General Liability?
It often can sit above a scheduled general liability policy, but the umbrella must list or otherwise include that policy and the claim must meet its terms.
Commercial general liability is a common underlying policy for umbrella coverage. Triple-I describes umbrella limits as sitting over scheduled underlying policies, typically including general liability, and California’s regulator says umbrellas cover amounts above basic liability limits. These descriptions do not establish that every CGL claim is covered by every umbrella.
The underlying CGL policy must usually meet the umbrella’s required limits and be maintained as specified. The umbrella may exclude a type of claim covered by the CGL, narrow its coverage, or require a self-insured retention where no underlying policy applies. Aggregate exhaustion can also affect how limits attach.
Check the umbrella schedule for the exact CGL policy and limits, then compare exclusions, definitions, occurrence and aggregate provisions, defense terms, and renewal conditions. Ask how a claim excluded by the CGL would be treated under the umbrella.
