Louisiana’s public contract law generally requires a performance bond for accepted public-work bids at no less than half the contract amount. What to Watch for in Louisiana

  • Check small-business reduced bond eligibility

    A qualifying Louisiana Economic Development-certified small business on a public contract of $200,000 or less may furnish half the bond amount called for, but statutory responsible-bidder and certification criteria apply. 1

  • Smaller public work may use a different form

    For public contracts of $50,000 or less, Louisiana law permits a performance-bond waiver for a responsible contractor or subcontractor meeting the statutory criteria; confirm award documents and any applicable payment bond separately. 1,2

  • Payment bond is not public-liability coverage

    The payment bond statute expressly says it does not create a cause of action for third-party personal injury or property damage. Ask separately for liability insurance required by contract. 2
