What to Watch for in Maine
Reasonable-person service standard
Maine § 2506 makes negligent service to a minor or visibly intoxicated person actionable when the server knew or a reasonable person in similar circumstances would know. It does not automatically impute knowledge of drinking away from the server’s premises absent appearance, behavior or other known facts suggesting it. 1
Common-consumption-area additional insured
For a common-consumption-area license, local officers may deny the license if the applicant does not maintain an acceptable, properly endorsed general-liability/liquor-liability policy naming the local licensing authority as an additional insured. Ask about that endorsement before applying. 2
Vendor staff can be treated as host servers
Maine law treats a vendor employee serving alcohol on a host licensee’s premises as a server of the host licensee for purposes of the Liquor Liability Act. For a shared event, identify the host, vendor and alcohol supplier in underwriting and policy schedules. 1
Keep statutory and policy notice separate
A plaintiff under the Maine Liquor Liability Act must give written notice to all defendants within 180 days of the server conduct creating liability, describing that conduct and resulting damages. Late notice can still be considered within § 2514’s limitations period if the plaintiff shows good cause. Keep this statutory process separate from prompt notice required by the policy. 3
Reckless service is a separate liability path
Section 2507 separately allows an action for reckless service to a minor or visibly intoxicated person. Its reckless standard requires conscious disregard or a gross deviation from reasonable care; the section identifies continued or excessive service creating substantial risk of death by alcohol poisoning as conduct that can qualify. Check whether the policy uses a different trigger or has exclusions affecting reckless-conduct allegations. 4
