    Section 9:2800.1(B) covers permit holders under Title 26 and their agents/employees who sell or serve alcohol to someone old enough to purchase; it limits liability to that adult and others for off-premises injury caused by the recipient’s intoxication. Do not generalize it to on-premises injuries or other theories. 1

  • Do not overlook express exceptions

    The limitation does not apply to a person who causes or contributes to consumption by force or falsely represents that a beverage contains no alcohol. Social-host treatment of adults is addressed separately in subsection C. 1

  • Delivery platform mandate is role-specific

    The $1 million per-occurrence endorsement requirement applies to third-party delivery companies/platforms and is a condition in the retail dealer agreement framework. A restaurant using a platform should collect the platform’s proof; a platform should review its own named insured, endorsement and term. 2

  • Do not rely on an unpassed minor-liability proposal

    SB 194 proposed adding a cause of action for certain underage service but the 2023 bill status is listed as pending in House Judiciary. The current § 9:2800.1 page does not include that proposed subsection. Recheck enacted amendments for any underage claim before using this guide in a live matter. 3,1
