Reckless Fault Can Be Compared; Intentional Fault Was Not Decided
The Idaho Supreme Court held reckless or willful-and-wanton fault can be compared with ordinary negligence under §6-801, but expressly did not decide intentional conduct. Keep those categories separate when discussing a claim with alleged aggravated conduct. 1
Do Not Apply the Two-Year Period to Every Claim
The court reads I.C. §5-219(4) as a two-year limit for personal-injury claims; it distinguishes constructive fraud and other claim categories. Ask counsel which limitation provision and accrual rule applies, and report incidents under the policy’s separate notice terms. 3
