What Insurance Covers AI Companies?

AI companies may need a mix of technology or professional E&O, cyber, media, intellectual property, and general liability coverage based on what they build and sell. No policy label alone establishes that a specific AI-related claim is covered.

An AI company’s coverage needs depend on its role: model developer, software vendor, consultant, data processor, or user of third-party models. Technology or professional E&O may be relevant to customer claims alleging a service error; cyber insurance may address specified security incidents and privacy claims; media or intellectual property coverage may be relevant to content and rights disputes. These lines address different exposures and their terms can overlap or exclude one another.

The NAIC identifies cyber liability and intellectual property insurance as distinct small-business liability categories, while Texas DOI describes professional liability as protection for claims arising from professional services. These are useful starting points, not a regulatory checklist or a conclusion that every AI business needs every line. An AI company selling a physical product, processing sensitive information, or making high-stakes recommendations can face materially different exposures from a company using AI internally.

Prepare a plain-language description of your products, customer promises, data handled, model providers, human review, and contractual indemnities. In each quote, ask whether the scheduled services include development and deployment of AI, whether outputs and training data create covered claims, how cyber and technology limits coordinate, and whether exclusions apply to IP, privacy, bodily injury, or performance guarantees. Confirm state-specific requirements and contract insurance obligations separately.
