What Is Patent Enforcement Insurance?
Patent enforcement insurance may help fund a policyholder’s action against an alleged infringer if the patent and enforcement option are covered. It is distinct from defending a suit.
Enforcement coverage addresses taking action over patent rights that the insured owns or is licensed to use. It differs from defense against an allegation that the insured infringed someone else's patent. CFC describes pursuit of infringers as covering legal costs of enforcement, negotiation, and defending counterclaims. IPISC's application describes enforcement expenses for scheduled rights. These are specific product descriptions, not a promise that every patent or case qualifies.
Ask which patents and products can be scheduled, what assessment the insurer requires before litigation, and who decides whether a proposed action meets policy conditions. Check attorney fees, experts, counterclaims, appeals, territories, cost-sharing, and any reimbursement or recovery terms. Determine whether enforcement shares limits with defense. Review notice and consent rules before sending a demand or filing suit, since taking action without following the contract may affect a claim. Ask for the policy and endorsement that describe enforcement; don't infer this protection from defense coverage.
