What Is Intellectual Property Litigation Insurance?

It is a broad label for insurance that may fund specified IP dispute expenses or liabilities. Confirm the covered claims, legal costs, enforcement rights, and limits in the form.

“IP litigation insurance” is not a single standardized coverage form. It may refer to defense expenses when a business is sued for infringement, or to legal costs for enforcing the business's own rights. The UK Intellectual Property Office describes products that may cover defense and enforcement separately, and IPISC's application also separates those options. UK guidance can explain the distinction but does not establish US policy terms.

Before comparing a product, identify the dispute side, rights, products, and territories involved. Check whether the grant includes lawyers, experts, appeals, counterclaims, settlements, judgments, or only defined litigation expense. Review the schedule, per-claim and aggregate limits, retention or copay, and whether costs erode limits. Ask who chooses counsel and what approval is required before starting a case. Clarify whether enforcement and defense share a limit or require separate selections. Obtain the actual policy, endorsements, and exclusions; a general marketing label cannot show which lawsuit costs qualify.
