What Is Copyright Infringement Insurance?

Copyright infringement insurance may address specified claims involving protected works, but the policy may distinguish defense from enforcing your own copyright.

Copyright insurance can refer to protection from an allegation that your business copied another party's work, help pursuing someone who copied your work, or both. The NAIC lists copyright infringement as an example of an IP insurance claim. CFC's product materials describe defense and pursuit sections; IPISC's application separately requests selected rights and products. Those sources show possible structures, not universal coverage.

Identify the works, software, images, text, or other materials involved and whether they are owned, licensed, or created for a customer. Ask if the grant includes defense, enforcement, settlement, damages, and expert expenses. Check exclusions for knowing conduct, contract obligations, software or source code, and prior disputes. Confirm territory, scheduled works, limits, retention, and insurer consent. If the content is distributed online or used in media, compare any media liability grant too. Request the exact form and endorsements rather than assuming that a copyright label covers every type of work or use.
