Do I Need Insurance for Uber Eats in Ontario?

Yes. Keep your own auto insurance in force and disclose delivery work. Uber’s published Ontario policy includes delivery orders, with different waiting and accepted-request limits. Vehicle enrollment, underlying repair coverage, insured-person rules and exclusions still need checking.

Personal Insurance and the Documents That Apply

Keep Your Personal Policy and Tell the Insurer About Deliveries

Uber’s Canadian delivery insurance page requires your personal automobile insurance to remain in force and tells you to inform your insurer or broker about delivery or ridesharing use. Ontario’s Compulsory Automobile Insurance Act separately prohibits an owner or lessee from operating, or allowing operation of, an uninsured motor vehicle on a highway. Neither requirement disappears because you deliver only on weekends. Describe restaurant orders, grocery deliveries, other apps, all drivers and the actual car. Obtain a written answer about permitted use, offline protection and any required endorsement. Uploading a pink card to Uber shows a document was supplied; it does not rewrite your personal insurer’s contract or establish every fleet-policy condition. 25,1,12

Check the Legal Minimum and the Permitted Use Separately

Insurance Act section 251 sets the ordinary automobile liability minimum at $200,000 per accident, apart from interest and costs. FSRA describes liability, accident benefits, uninsured automobile and qualified direct-compensation property-damage protection as distinct parts of automobile insurance. That ordinary minimum does not describe Uber’s online limits or determine an appropriate purchase for your circumstances. Registration guidance also requires valid insurance and vehicle documents. A policy can have a substantial liability limit while presenting a problem with delivery use, a particular driver or vehicle damage. Ask about all those elements together rather than using the smallest legal dollar figure as a complete delivery-insurance checklist. 2,8,15

The Public Canadian Delivery Agreement Is Dated July 2021

Uber’s Canadian help article expressly concerns agreements starting July 1, 2021 and links a delivery agreement with that date. An original Canada logistics PDF is also publicly hosted by Uber. Its insurance section requires motor-vehicle liability insurance, proof on request, disclosure to the insurer and notice of insurance changes. Those are useful documented contractual provisions, but this historical copy does not establish which agreement and addenda you accepted today. The help article describes Uber Portier Canada buying and reselling delivery services; that business model is not an insurance certificate. Keep the dated contract distinct from the current Ontario policy and obtain your applicable app documents before resolving an individual contractual dispute. 26,27

Report Insurance Changes to the Platform and the Insurer

Section 7 of the historical Canadian agreement requires the person delivering by motor vehicle to be the policyholder or an individually rated driver, provide insurance proof on request, tell Uber immediately about a change in insurance status and inform the insurer about delivery use. OAP 1 section 1.4 and the statutory conditions separately address material changes in the insured risk. These duties involve different recipients and documents. Renewing a card in the app does not prove that a personal insurer accepted a new driver, different vehicle or changed activity, and telling a broker does not establish that the platform updated its records. Confirm the current accepted contractual requirements, notify the appropriate parties and keep their responses. A lapse, cancellation or removal of collision coverage can affect more than whether the app permits another login. 26,21,12

The Current Public Policy Actually Lists Delivery Orders

The issuer library linked by Uber supplies Ontario policy 6962301, prepared August 13, 2026, for September 1, 2026 through September 1, 2027 under its certificate time provision. It names Definity Insurance Company; Uber’s page uses the Economical name. Schedule 1 includes Uber Portier Canada and defines compensated transportation of goods through the specified Uber network. EPCF 21A separately lists transportation of delivery orders. This is direct delivery evidence, rather than an assumption based only on the word ridesharing in the endorsement title. The public packet still does not authenticate your enrollment, the automobile schedule, later amendments or insurance at a particular accident date. 22,25

A Regulator Listing and a Standard Form Answer Different Questions

FSRA’s approved-program page lists an Uber ridesharing product. Its separately presented delivery-program list does not itself prove that Uber Eats is uninsured: the actual Uber policy includes goods and delivery orders, and Uber publishes an Ontario delivery table. Read those documents together. The attached fleet OAP 1 is labeled EN.4 (2026), approved for use from July 1, while FSRA separately posts a July 2026 EN.5 copy. A form-library entry does not establish that every sentence is identical or automatically amend an existing contract. Use the actual certificate and endorsements, with applicable statutes and statutory conditions, rather than silently replacing the packet with a different downloaded form. 10,22,25,21

Waiting, Pickup, Delivery and Returns

Waiting Cover Requires Being Logged On and Available

EPCF 6TN defines pre-acceptance by both logging onto the specified Uber network and being available for compensated transportation requests originating in Ontario, before acceptance or logout. Its published liability limit is $1 million. It also lists qualified DCPD, uninsured automobile, family protection, accident-benefit provisions and conditional collision and comprehensive. These are separate protections with separate conditions, not a million-dollar repair allowance. If you are parked outside a restaurant before accepting anything, establish whether you were genuinely available through the relevant network and whether the actual car and driver qualify. A screenshot showing the app installed, or merely open on a phone, cannot settle those questions. 22,25

Acceptance Includes Travel to the Merchant

The post-acceptance period starts when a driver accepts an Ontario-origin transportation request through the specified network. It expressly includes driving to collect goods, pickup, carriage and drop-off, with a published $2 million liability limit. You do not have to wait until a food bag is physically in the car to examine this period. Conversely, a delivery destination in Ontario does not by itself establish that the accepted request originated there. Retain the request, acceptance, pickup and destination records that explain the actual journey. The policy’s insurance geography also does not establish permission to collect or deliver every product in every location or to use every vehicle category. 22,25

Read Cancellations and Requested Returns in the Actual Sequence

The endorsement’s ending provision considers the last goods being delivered, completion of a return to origin requested through the network, a trip ending and a cancellation, using a whichever-is-later rule. This matters when an alcohol recipient cannot receive an order or a merchant asks for goods back. The dated Canadian agreement separately contemplates returns following certain cancellations and regulated-item problems. Do not convert those clauses into an unlimited promise covering every later drive back to a restaurant: establish the app request, goods, completion and trip events. Save the relevant return instruction and timestamps. A cancellation label alone is an incomplete account of the policy’s defined ending language. 22,26

Keep Evidence for Every Order in a Batch

The fleet wording refers to the last goods delivered, while the agreement allows different delivery options and describes pickup and communication responsibilities. For a batch involving two merchants or recipients, preserve each request’s acceptance, collection, completion, cancellation and return details. This is a practical consequence of those definitions, not a separate insurance promise for every route deviation or overlapping assignment. Ask the insurer how it applies the actual wording to the sequence and covered service. Avoid deleting the first order’s evidence simply because a second order remained active. The number of bags or a higher delivery fee does not, by itself, multiply the applicable policy limit or create cargo insurance. 22,26

Other Apps and Offline Errands Need Their Own Answer

EPCF 6TN supplies primary cover only in its defined periods, subject to its limitations and exclusions. Schedule 1 ties the service to the specified Uber network and excludes app-off use, taxicabs and commercially licensed limousine or livery services from its ridesharing definition. The 2021 delivery agreement allows other work and applications; that contractual freedom does not extend Uber’s policy to another platform’s delivery. Disclose concurrent apps and record which request you accepted. An offline grocery trip for yourself or a private courier booking cannot simply inherit the published Uber Eats snapshot. Commercial operations, mixed activities and disputed overlap require the applicable policies and actual facts to be examined separately. 22,26,25

The Driver, Car, Delegate and Delivery Mode

An Active Account Is Not an Automobile Schedule

Schedule 1 defines the driver and vehicle owner, and EPCF 21A specifies eligible ownership and lease categories. Its automobile schedule must include the relevant vehicles; an existing owned or leased automobile omitted from the schedule receives no coverage under that change form until a coverage request has been filed. A replacement household car therefore deserves more than an app-profile update. Confirm the actual vehicle, registration, person driving, delivery use and applicable schedule. The fleet’s monthly premium-reporting process is not proof that a particular driver personally owes a monthly fleet return or that an omitted vehicle becomes insured automatically when the platform later reports its mileage. 22

Lawful Possession Does Not Establish Complete Rental or Borrowed-car Cover

The historical agreement permits an owned, leased or lawfully possessed transportation method and warns that private, rental and leasing policies may exclude delivery losses. The current fleet endorsement has more specific insurance categories: qualifying leases over 30 days differ from rentals of no more than 30 days, for which it identifies only particular liability provisions and conditions. Do not read the ability to rent a car as a promise of fleet collision or comprehensive. Obtain the rental company’s delivery permission, applicable insurance and endorsements, underlying coverage and schedule confirmation. Borrowed cars also raise owner-versus-driver questions. This guide’s ordinary owned-car snapshot is withheld for those arrangements rather than treating them as equivalent. 26,22

Canada Allows a Delegation Process With Conditions

Uber’s Canada-only delegation help says a delegate must first have an active delivery-person account, each delegate must be nominated beforehand, and the account holder must follow the stated eligibility and addendum process. Its Community Guidelines prohibit unauthorized account sharing while linking the jurisdictional substitution exception. Those provisions should be read together; a generic account-sharing sentence is not a basis for erasing the Canadian process. The 2021 agreement also makes the person appointing a delegate responsible for appropriate insurance arrangements. Portal eligibility does not establish that the actual delegate, automobile, underlying policy and activity meet the current fleet terms. Obtain that insurance answer before someone else performs deliveries on your behalf. 28,29,26,22

Use the Transportation Method Actually Approved and Insured

The dated agreement requires the transportation method used to match the method registered on the driver account. Its section 7(h) states a serious insurance consequence when a person declares a bicycle or another non-motor method but actually uses a motor vehicle. Treat that as wording in a dated agreement, not an individual claim decision under an unseen current addendum. Current Community Guidelines also require approved vehicles. Uber’s Ontario automobile table is expressly about delivery by car; it does not establish equivalent protection for bicycles, walking couriers, motorcycles or scooters. Correct a mode mismatch with the platform and insurer instead of assuming the ordinary-car limits transfer to the declared bicycle account. 26,29,25

An E-bike Label Does Not Decide Its Ontario Legal Class

Ontario’s e-bike guidance specifies working pedals, speed, power, weight, equipment and operating requirements. It says removing the pedals makes the device a motor vehicle requiring a licence, insurance and registration, and prohibits modifications that increase motor power or assisted speed beyond the stated limits. A seller’s e-bike description therefore does not settle the classification of a modified delivery vehicle. Separately check municipal riding restrictions and the mode accepted by Uber. This is a classification issue, not evidence that the reviewed car policy covers a bicycle or that a non-car courier has equivalent injury and third-party protection. The checker withholds the ordinary-car snapshot when another mode is selected. 30,25,26

Car Repairs, Food, Equipment and Lost Earnings

Both Underlying Collision and Comprehensive Are Required

The public policy lists contingent collision and comprehensive with a $2,500 deductible for delivery orders. EPCF 6TN section 3 and EPCF 21A section (h) condition those coverages on the vehicle owner having both collision and comprehensive under the underlying Ontario automobile policy for the actual car. The certificate uses driver wording, a distinction to clarify where owner and driver differ. A liability-only personal policy, or buying comprehensive without collision, cannot be treated as meeting both conditions. Confirm the coverages remain in force and ask what happens after any change. The deductible is not a purchase price that lets you obtain fleet repairs regardless of underlying insurance, eligibility or cause of loss. 22,25

A Not-at-fault Collision Can Use a Different Repair Route

The fleet endorsement lists DCPD with a $0 deductible. OAP 1 section 6 and Insurance Act section 263 impose their own conditions, including an Ontario accident and another involved automobile insured by a qualifying insurer. Payment depends on the share for which the driver is not at fault under the applicable rules. Regulation 668 supplies those rules; its diagrams and defined accident situations matter more than a universal shortcut that every partly at-fault driver receives half. The remaining damage may require separate collision protection and its deductible. Keep DCPD distinct from contingent repairs, uninsured-driver protection and the third-party liability headline when discussing the damaged delivery car. 22,2,5,8

An OPCF 49 Election Can Affect More Than One Repair Coverage

Ontario permits a written election not to recover DCPD damages. The approved OPCF 49 warns about losing protection for the automobile, contents and loss of use even when another driver is responsible, and about collision protection no longer being available under the affected policy. Regulation 664 section 5.2 addresses election and revocation. Do not assume that anyone made this election simply because the form exists, or that an election under one policy establishes every result under another. If it affects your personal coverage, ask how the fleet’s requirement for underlying collision and comprehensive is satisfied. Financing obligations can remain even where a selected insurance protection has been removed. 16,20,22

The Delivery Order Is Not Automatically Insured as Cargo

The attached OAP 1 excludes liability claims for property carried in or on the automobile and other property in an insured person’s care, custody or control; it also excludes claims arising from contamination of property carried in the car under that liability section. Its DCPD section expressly excludes damage to, or loss of use of, contents carried for reward. Those clauses are directly relevant to food and goods being delivered. A policy that insures the use of the car for delivery does not thereby reimburse every spoiled order, broken bottle or damaged package. Ask about the specific property, alleged liability, relevant exclusions and any separately purchased cargo or business protection. 22

Food-handling Duties Are Not a Spoilage Insurance Benefit

Uber’s Community Guidelines address safe delivery, merchant handling instructions and leaving packaging unopened. The dated agreement separately requires compliance with applicable rules for regulated items, suitable equipment and safe vehicle condition. These are operating obligations, not a food-spoilage schedule. If a hot order leaks, an insulated bag fails, a phone is stolen or a customer alleges an injury after delivery, identify the actual loss and legal allegation before asking which contract applies. The automobile loss-or-damage section also has limitations for non-equipment contents and ordinary wear. No reviewed document establishes automatic reimbursement for every delivery bag, phone, mechanical breakdown, customer refund or business interruption. 29,26,22

A Total-loss Settlement Is Not the Outstanding Loan Balance

The OAP 1 vehicle-damage provisions use actual cash value and repair or replacement rules, with depreciation and applicable deductibles. A fleet limit or lienholder schedule does not promise the purchase price, a new replacement vehicle or payment of the remaining finance balance. Keep the car’s condition, mileage, options and repair estimates so a disputed valuation can be explained. Distinguish the amount owed to a lender from the insured value and ask about any separate gap or replacement-cost protection actually purchased. A lessor’s or lienholder’s name in an endorsement protects a defined interest under stated terms; it does not create an unlimited debt guarantee for the delivery driver. 22,11

Rental Transport and Lost Delivery Earnings Need Specific Wording

The attached OAP 1 includes a limited whole-car theft transportation provision: the stated protection begins after 72 hours following the required theft report and has a $900 maximum, subject to its conditions. That is not universal rental reimbursement after every collision. FSRA’s optional-coverage guidance and OPCF 20 describe separately purchased replacement transportation under its terms; a posted form is not evidence it was added to your policy. Also distinguish permitted use of a substitute rental from paying its rental cost. Time without delivery income is another question: neither a liability limit nor a car-repair payment establishes a general business-income benefit for every day the car is unavailable. 22,9,17

Injury Benefits, Family Protection and Workplace Status

Read the Selected Benefits After the July 2026 Reform

Ontario’s July 1, 2026 changes make benefits other than medical, rehabilitation and attendant care optional within the applicable framework. They do not mean every existing or fleet policy dropped every other benefit on July 1. The SABS contains transition and renewal provisions, and FSRA’s reform materials explain the changed purchasing structure. The September Uber packet explicitly includes several optional benefits and leaves other enhancements unpurchased. Uber’s broad phrase standard accident benefits cannot resolve those selections by itself. Compare the actual certificate, endorsements, covered-person rules and accident date. An older all-benefits summary and a blanket statement that only medical benefits remain would both miss what this current public packet actually schedules. 3,6,7,22,25

The Published Fleet Schedule Includes Income and Other Benefits

The certificate and EPCF 21A include income replacement up to $400 per week, non-earner benefits and specified caregiver, educational, visitor, personal-item, death and funeral benefits. Caregiver and housekeeping selections have catastrophic-only qualifications; enhanced medical and rehabilitation limits, additional catastrophic enhancement, dependant-care benefits and indexation are not purchased as shown. These entries describe scheduled protections, not automatic payments to every courier. Read the applicable eligibility, expense, impairment and offset rules before treating a weekly limit as guaranteed income. In particular, an order history proving you delivered food does not alone establish the disability test, all required earnings evidence or which optional benefit applies to the person seeking payment. 22,3

Self-employed Earnings and Injury Eligibility Need Their Own Evidence

SABS sections 5 through 7 address income-replacement eligibility and calculation, including employment or self-employment circumstances, the initial waiting period, the generally applicable 70 percent income calculation, offsets and the purchased weekly ceiling. The disability test also changes after 104 weeks. Keep accurate work, earnings, expense and medical evidence; do not substitute gross delivery receipts or the largest week in the app for the statutory calculation. Mandatory medical, rehabilitation and attendant-care benefits have separate injury classifications, expense rules and limits under section 18. A covered collision and a scheduled $400 maximum are therefore only parts of an injury-benefit assessment, rather than proof of a particular courier’s final weekly entitlement. 3,22

Injury Categories and Optional Enhancements Change the Available Amount

SABS section 18 distinguishes the minor-injury framework from other non-catastrophic and catastrophic impairments. Its ordinary combined medical, rehabilitation and attendant-care limits include $65,000 for the stated non-catastrophic category and $1 million for catastrophic impairment, with a $3,500 medical-and-rehabilitation minor-injury limit and specified exceptions needing separate attention. The current Uber packet shows the increased medical, rehabilitation and attendant-care option and additional catastrophic enhancement as not purchased. Do not add those unpurchased enhancements to the scheduled standard amounts or assume that every serious symptom satisfies the statutory catastrophic definition. These statutory amounts have applicable HST provisions. Expenses, assessments, treatment and eligibility also require the actual rules to be read. Ask the insurer which classification, limit and benefit selections it is applying to the injured courier, and retain its written explanation. A customer refund, damaged order or vehicle-repair invoice is not evidence of that medical classification. 3,22

OPCF 47R Changes Specific Benefits and Priority Questions

The actual packet includes OPCF 47R, while FSRA’s October 14, 2026 fleet guidance discusses optional benefits, covered persons and deemed named insureds. Named insureds, spouses, dependants and listed or otherwise qualifying drivers require careful treatment; a name on an app account is not a substitute for the policy and statutory definitions. OPCF 47R’s priority provisions depend on the stated election and conditions, including seeking the relevant benefits under that policy rather than simultaneously pursuing the same optional-benefit claim elsewhere. Separately posted forms help explain the framework but do not prove an individual election or later fleet amendment. Ask for the insurer’s written insured-person and priority explanation before assuming benefits stack. 22,19,23,3

Uninsured and Family Protection Are Not Extra Collision Limits

The packet lists uninsured automobile protection under OAP 1 section 5 and family protection under OPCF 44R, with $1 million pre-acceptance and $2 million post-acceptance family-protection limits. Family protection concerns qualifying injury or death involving an inadequately insured motorist, with definitions, deductions, evidence and recovery provisions; it is not an additional car-repair allowance. Section 5’s identified-uninsured property route has its own $25,000 limit and $300 deductible, and unidentified-vehicle damage is excluded under that section even though another purchased coverage may be relevant. The separately posted approved OPCF 44R is useful context, but the attached form and applicable law govern the actual fleet question. 22,18

A Contractor Label Does Not Decide WSIB Coverage

WSIB’s July 2026 independent-operator guidance specifically discusses transportation, rideshare, courier and third-party food-delivery work. It uses the actual business relationship and applicable status process rather than treating every platform’s independent-contractor description as conclusive. Its vehicle-identification instructions also distinguish reuse of a status ruling for the same vehicle from a changed vehicle. The historical Uber agreement requires workers’ compensation where legally required, but that clause does not resolve a statutory status question. Ask WSIB about the relevant relationship, registration or optional coverage where needed. Workplace insurance, automobile accident benefits and separately offered accident products have different eligibility and coordination rules; none should be inferred merely from an active delivery account. 24,26,3

Report the Incident and Preserve the Right Evidence

Platform Reporting and Insurance Notice Are Separate Steps

The July 2021 agreement requires notice to Uber within 24 hours of an incident during delivery and cooperation with its reporting process. Treat that as a dated contractual provision and check your applicable accepted terms. It is separate from the attached OAP 1’s written seven-day notice provisions, with their stated incapacity qualifications, and from statutory accident-benefit applications. Notify the relevant insurer promptly and give accurate available facts. Sending a support message does not establish that the insurer received the necessary notice or claim forms. Preserve when, where and to whom each report was sent, along with the actual request, driver, vehicle, pickup and return sequence. 26,22,11

Injury Notice and the Application Have Different Timelines

SABS section 32 generally calls for notice of an intention to apply within seven days after the circumstances giving rise to entitlement arise, or as soon as practicable after that, and a completed application within 30 days after receiving the forms. Section 34 addresses a reasonable explanation for certain failures; it is not a reason to delay deliberately. The requested evidence can differ by benefit and injury. Keep proof of the insurer’s receipt, the forms supplied and any explanation requested. These are distinct from vehicle estimates, Uber’s incident channel and a later complaint or tribunal application. If a deadline has been missed or the insurer disputes entitlement, obtain timely advice about the applicable provision and the actual facts instead of assuming every claim is automatically lost or automatically excused. 3,11

Unidentified-driver and Family-protection Claims Need Early Evidence

OAP 1 section 5 has specific reporting and evidence conditions for an unidentified motorist injury claim, including the stated police-reporting and written-statement time requirements with their qualifications. OPCF 44R adds its own notice, corroboration and recovery provisions. A customer’s cancelled order or an Uber incident number does not replace those requirements. Preserve witnesses, safe photographs, available recordings and insurer correspondence without publishing private customer details. Determine which protection you are invoking: an unidentified vehicle damaging your parked car is not automatically the same claim as an injury caused by an inadequately insured motorist. Prompt advice can matter while evidence is available and contractual or statutory time periods are running. 22,18

Protect the Car and Distinguish an Estimate From Proof of Loss

The attached statutory conditions require reasonable steps to prevent further damage and specified proof for automobile loss, including a sworn declaration within 90 days under the stated condition. They restrict nonessential repairs and destruction of evidence before insurer consent or a reasonable inspection opportunity. Keep repair estimates, vehicle-condition records, purchase or finance documents where relevant and the chronology of app work. Ask which documents remain outstanding rather than assuming a preliminary photograph-based estimate is completed proof of loss. Insurance Act section 128 provides an appraisal framework for certain valuation disputes. An appraisal addresses its defined subject; it does not automatically decide delivery-use eligibility, every coverage dispute or all losses claimed. 22,2,11

Settlement Timing and Legal Limitation Periods Are Different

The OAP 1 statutory conditions state payment requirements for money the insurer is liable to pay: generally 60 days after proof of loss without appraisal, or 15 days after the appraisers’ determination in the stated appraisal situation. Repair or replacement elections have other notice and reasonable-time provisions. Those clauses are not a guarantee that every claim closes within 60 days of the accident. The conditions also contain distinct action periods for automobile or contents loss and for persons or other property. Obtain prompt advice about the applicable law, contract, proceeding and possible relief. A pending app conversation, complaint, repair negotiation or appraisal does not itself prove that a legal deadline has stopped. 22,2

Resolve the Specific Outstanding Question

An Insurer-priority Dispute Has Its Own Process

Ontario Regulation 283/95 requires an insurer notified of an intention to seek benefits to provide appropriate forms. An insurer supplying the application must not obstruct completion, refuse it or redirect the applicant. The first insurer receiving a completed application must commence benefits in accordance with the SABS while the insurer-priority issue is resolved. That procedural obligation does not establish eligibility for every requested benefit or justify inconsistent claims. Keep receipt records and distinguish the insurers’ priority dispute from your entitlement or amount dispute. Ask for the actual reason and applicable process when referred between insurers, rather than relying on an unsupported instruction to wait for all inter-insurer questions to finish. 4,2,3

Use the Insurer Complaint Process for the Insurance Decision

FSRA directs consumers to the insurer’s complaint officer and asks for a final position letter in its complaint process. Retain the wording relied upon, the insurer’s decision, your requested resolution and relevant correspondence. A platform account complaint may need a different channel from a policy or claims-handling concern. FSRA’s consumer guidance describes rights and duties, but regulatory review does not guarantee compensation, replace an application or suspend court and tribunal deadlines. Send claim or medical documents only through the appropriate secure process. Identify whether the real issue is missing evidence, policy interpretation, service, valuation, entitlement or insurer priority before assuming one general support ticket will resolve all of them. 13,12

LAT-AABS Does Not Decide Every Automobile Dispute

Insurance Act section 280 and Tribunals Ontario’s LAT-AABS guidance concern statutory accident-benefit entitlement and amounts. LAT-AABS does not decide car damage, fault, pain-and-suffering claims or which insurer has priority. Its guidance generally describes a two-year application period after the insurer’s denial notice and possible extensions. That timeline should not be substituted for the different contractual and legal questions affecting property or family-protection proceedings. Obtain advice promptly if a denial or limitation issue arises, including where time may already have passed. A complaint, ongoing correspondence or an assumption that the insurer is still reconsidering does not establish that a particular tribunal or court period has been preserved. 14,2,22
