Louisiana policy documentation for virtual-currency businesses
Louisiana’s Virtual Currency Business Activity law requires an applicant to submit certificates for liability, casualty, business-interruption and cybersecurity policies it actually maintains for itself and specified related persons in connection with virtual-currency activity. It is a disclosure requirement, not a command to buy every policy. Separately, a licensee holding resident assets must meet statutory same-type-and-amount and anti-commingling rules. 1,2
What Is Digital Assets?
Digital-asset coverage may address custody, theft and business-liability risks, but a custodian’s policy may protect the custodian rather than you. If you hold or safeguard assets, verify the insured entity, wallets, key-loss protection and valuation. Read the national Digital assets guide.
Louisiana Requirements
| Requirement | Details |
|---|---|
| Inventory existing policy certificates | For an application under the virtual-currency business activity law, identify and provide certificates for liability, casualty, business-interruption and cybersecurity policies actually maintained for the applicant or specified responsible affiliates, agents and control persons with respect to the activity. 1 |
| Reconcile customer assets separately | A licensee storing, holding or controlling virtual currency for a Louisiana resident must hold the same type and amount and may not sell, transfer, lend, pledge, encumber or commingle it except as the statute permits or directs. 2 |
What to Watch for in Louisiana
The application asks what you already maintain
Section 6:1385 requests certificates for policies actually maintained. It does not require an applicant to purchase every listed policy or guarantee the policy is adequate. 1
Match the certificate to the application parties
The statutory list includes specified affiliates, agents and responsible individuals in connection with the business activity. Coordinate the named insureds and policy schedule with the actual applicant structure. 1
Asset segregation does not expand policy coverage
Section 6:1386.2 sets custody and anti-commingling duties. Those legal safeguards do not establish that an insurer covers shortages, theft or key loss. 2,4,5
Who Regulates Insurance in Louisiana

Louisiana Department of Insurance
The Louisiana Department of Insurance licenses producers and insurers, reviews insurance filings, and investigates complaints about insurance companies and agents. You can use its state lookup or complaint service to check a license or raise an insurance issue. 6,7,8
Surplus-lines tax and stamping office
Reported tax rate: 4.85% of gross premium plus a 0.175% SLIP+ transaction fee for policies effective on or after July 1, 2026 For Louisiana-home-state policies effective on or after July 1, 2026, the state charges 4.85% of gross premium plus a 0.175% SLIP+ transaction fee, which your broker may add to your bill. Louisiana's required policy disclosure says these policies are not covered by the Louisiana Insurance Guaranty Association; state placement and filing rules still apply. 9,10
Providers With Documented State Licenses
No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.
Questions to Ask Before You Buy in Louisiana
- Which Louisiana entity is the license applicant, and which affiliates, agents or control persons have certificates relevant to the activity?
- Do the certificates and underlying schedules identify the actual entity, virtual-currency service and assets being represented?
- Can you reconcile the customer assets under the statute to the wallets, keys and sub-custodians described to the insurer?
- Ask whether the actual policy addresses external theft, internal misuse, lost keys and customer liability; the application certificate requirement is not a claim decision.
