[Get Started](https://app.spot.insure/signup?coverage=fiduciary). Spot is not an insurance carrier and takes no commissions on premiums; you can keep your broker or switch.

## How Spot helps

1. **List the plans and who runs them.** Your Spot team collects your benefit plans, plan types and assets, participant information, who makes investment decisions and any past claims or known disputes, then prepares the submission.
2. **Check what each quote insures.** Once brokers bring proposals back, we show which people, sponsoring organizations and plans each one insures, and whether it addresses errors in enrollment, records and communications as well as alleged breaches.
3. **See what counts as a covered claim.** Spot flags how each wording separates a covered liability claim from benefits your plan owes, and how intentional-misconduct exclusions treat defense expenses.
4. **Keep notices and renewal dates together.** When a claim must be made and reported, and how prior proceedings and earlier notices affect coverage, are set by the policy. Spot keeps your policy and notices together and starts the renewal early.

## Who we help

- **Employers with a 401(k) or retirement plan.** Someone on your team chooses the investments and the provider, and that choice can be challenged.
- **Plan committee members.** You serve on the committee as part of your job, so check that the policy insures you personally.
- **Companies that offer health or welfare plans.** Enrollment, records and communications for those plans can go wrong without any dishonest act.
- **Employers that already carry a plan bond.** The bond covers dishonest handling of plan assets. A claim that someone breached their duties to the plan calls for fiduciary liability.

## When to get this coverage

- **You’re setting up a retirement plan.** The people choosing providers and investments can take on duties to the plan once it starts, so settle coverage when the plan launches.
- **You changed your plan provider or investment menu.** Decisions like these are what a claim would look back on. Tell your Spot team so the application and policy reflect them.
- **Your committee membership changed.** Check that the policy insures the people who now sit on it and the plans they now oversee.
- **You added a health or welfare plan.** Confirm the new plan is scheduled on the policy rather than assumed to be covered.
- **Your fiduciary policy is up for renewal.** Compare how defense expenses affect the limit and what retention applies, and share any plan disputes before you renew.

## Common questions

Also known as fiduciary insurance, ERISA fiduciary liability insurance and 401(k) fiduciary insurance.

### Can the broker who handles our benefits place fiduciary liability?

Often, yes. Spot works with your benefits or commercial broker to take it to market and takes no commissions on premiums. You can also place it through a different broker, and we’ll help you move it.

### What does fiduciary liability cover?

It can help respond to covered claims alleging breaches of duties in managing employee benefit plans, such as a 401(k) governed by ERISA. Which people and plans are insured depends on the policy wording.

### Is this the same as a fidelity bond?

No. A fidelity bond addresses dishonest handling of plan assets. Fiduciary liability addresses alleged breaches of plan duties. Neither stands in for the other.

### Does it pay the benefits my plan owes?

Not as a rule. Policies distinguish a covered liability claim from benefits the plan itself owes, with detailed exceptions. Spot points out how each quote draws that line.

### Can we settle a plan dispute on our own?

Check first. A policy can require you to notify the insurer and get its consent before you commit to defense expenses or a settlement. Ask the Spot agent to find those conditions in your policy.

### What will brokers ask about our plans?

A list of your benefit plans with types and assets, participant information, who makes investment decisions, and any past claims or known disputes.
