# Does Workers’ Comp Cover Contractors?

Workers’ comp may cover a contractor classified as your employee under state law; an independent contractor with separate coverage is a different case.

New York says direct control can make a worker an employee despite the tax label and notes that many subcontractors may be covered. Other states apply their own tests and exceptions.

Check each state’s worker test and verify the contractor’s current coverage. Review your policy’s subcontractor and audit terms; a certificate does not decide legal status or change your coverage.
