# Does D&O Cover Employees?

Some D&O policies include employees as insureds for defined acts in an insured capacity.

Some D&O policies include employees as insureds for defined acts in an insured capacity.

Some forms include employees as insured persons, but that does not make every employee-related dispute a D&O claim. Side A or B may apply to a covered management claim against an eligible employee; Side C depends on a separate entity grant. Employment exclusions and insured-versus-insured provisions can narrow claims, while a separate EPLI section may respond to allegations such as discrimination or harassment. Check how the form treats current and former employees, applicants, wage claims, and claims by the company. Confirm whether EPLI is included, separately limited, or shares the D&O aggregate.
