# Insurance Buying Guide for Legal Businesses

[B2B](https://spot.insure/industries/b2b)

Decide whether the company practices law, sells legal software, or does both. Before accepting a client matter, opening a trust account, or launching software, describe the work, data, jurisdictions, and money flows to the broker. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Chapter 1. Lawyer-Client Relationship](https://www.calbar.ca.gov/legal-professionals/rules/rules-professional-conduct/current-rules-professional-conduct/chapter-1-lawyer-client-relationship), [Cyber Insurance](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity/cyber-insurance)

## Which Insurance Should You Consider?

Consider professional errors and omissions (E&O), cyber liability, crime, technology errors and omissions (E&O), and general liability. Start with the coverages tied to your day-to-day operations, then use the situations and buying questions below to compare your options.

### [Professional errors and omissions (E&O)](https://spot.insure/coverage/professional-errors-omissions)

**When it matters:** A client relies on legal advice, document work, representation, or another professional service. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Launch your business — Get business insurance](https://www.sba.gov/counseling/launch-your-business/)

**What to review:** NAIC describes professional liability broadly for service or advice errors. Ask how the proposed form defines your actual legal services and insured people. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Launch your business — Get business insurance](https://www.sba.gov/counseling/launch-your-business/)

**Ask:** Which services, jurisdictions, entities, and alleged financial losses are addressed, and what exclusions or claims-made conditions apply? [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Launch your business — Get business insurance](https://www.sba.gov/counseling/launch-your-business/)

### [Cyber liability](https://spot.insure/coverage/cyber)

**When it matters:** You hold matter files, identity data, confidential client communications, or credentials. [Cyber Insurance](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity/cyber-insurance), [Chapter 1. Lawyer-Client Relationship](https://www.calbar.ca.gov/legal-professionals/rules/rules-professional-conduct/current-rules-professional-conduct/chapter-1-lawyer-client-relationship)

**What to review:** FTC describes cyber first-party costs and third-party claims as comparison topics. California lawyers also have a professional confidentiality duty with exceptions; that rule does not establish insurance response. [Cyber Insurance](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity/cyber-insurance), [Chapter 1. Lawyer-Client Relationship](https://www.calbar.ca.gov/legal-professionals/rules/rules-professional-conduct/current-rules-professional-conduct/chapter-1-lawyer-client-relationship)

**Ask:** Which incident response, restoration, notification, vendor, interruption, and client-claim scenarios does the form address? [Cyber Insurance](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity/cyber-insurance), [Chapter 1. Lawyer-Client Relationship](https://www.calbar.ca.gov/legal-professionals/rules/rules-professional-conduct/current-rules-professional-conduct/chapter-1-lawyer-client-relationship)

### [Crime](https://spot.insure/coverage/crime)

**When it matters:** Staff can access client trust funds, operating accounts, or payment instructions. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**What to review:** Ask whether a crime quote addresses employee theft. Client trust-account theft, outside fraud, and redirected transfers remain form-specific questions; no response is assumed. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which persons, accounts, theft events, social engineering, and client-fund scenarios are defined or excluded? [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

### [Technology errors and omissions (E&O)](https://spot.insure/coverage/technology-errors-omissions)

**When it matters:** You sell document automation, matter management, research, or other legal software. [Cyber insurance coverage & products](https://www.chubb.com/us-en/business-insurance/products/cyber-insurance/cyber-insurance-products.html), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**What to review:** Separate legal advice and representation from software hosting, integrations, and implementation. Ask which proposed form identifies each activity as an insured professional service. [Cyber insurance coverage & products](https://www.chubb.com/us-en/business-insurance/products/cyber-insurance/cyber-insurance-products.html), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which software, hosting, integrations, and service failures fit the definition, and how does it coordinate with professional-services wording? [Cyber insurance coverage & products](https://www.chubb.com/us-en/business-insurance/products/cyber-insurance/cyber-insurance-products.html), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

### [General liability](https://spot.insure/coverage/general-liability)

**When it matters:** Clients visit your office or staff conduct in-person events or services. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**What to review:** General liability is broadly associated with bodily injury and damage to others’ property. Describe premises and activities and compare the actual form and exclusions. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which office, client visits, and events are listed, and what limits or exclusions apply? [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

## Law Practice and Legal Software Are Different Activities

If you practice law, describe the legal work, client types, jurisdictions, and who provides advice. If you sell software, describe hosting, data, integrations, and service commitments separately. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Cyber insurance coverage & products](https://www.chubb.com/us-en/business-insurance/products/cyber-insurance/cyber-insurance-products.html)

California Rule 1.6 applies to California lawyers and has exceptions. It informs confidentiality decisions for that scope; it does not tell you which insurance form responds. [Chapter 1. Lawyer-Client Relationship](https://www.calbar.ca.gov/legal-professionals/rules/rules-professional-conduct/current-rules-professional-conduct/chapter-1-lawyer-client-relationship)

## Before Opening an Account or Taking Payment Instructions

Map who can access trust and operating funds, approve transfers, or change client payment instructions. Ask the insurer to address employee theft and outside payment diversion separately. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

Do not infer fraud protection from a crime or cyber label. Compare definitions, insured persons, exclusions, and limits in the proposed forms. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Cyber Insurance](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity/cyber-insurance)

## Before Expanding Client Data or Vendors

List client records, storage locations, vendors, access permissions, and incident-response responsibilities. FTC recommends supplier-risk assessment and asks buyers to examine vendor-held data when comparing cyber terms. [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Cyber Insurance](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity/cyber-insurance)

Ask the broker to compare notification, restoration, vendor-event, and client-claim terms across the proposed cyber forms. [Cyber Insurance](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity/cyber-insurance)

## Providers to Compare by Coverage

These providers document the coverage listed below. Examples are alphabetical, not a ranking or confirmation that your business qualifies. Scores describe the provider, not an individual policy.

## Common Questions

### Does a law-practice professional policy cover legal software?

Do not assume it does. Ask whether the policy defines software, hosting, integrations, and service commitments as insured professional services, or whether separate technology wording is proposed. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Cyber insurance coverage & products](https://www.chubb.com/us-en/business-insurance/products/cyber-insurance/cyber-insurance-products.html)

[Read the full answer](https://spot.insure/industries/legal/does-legal-eo-cover-software)
### Does a confidentiality duty mean cyber insurance covers a client-file breach?

No. California Rule 1.6 concerns a California lawyer’s confidentiality duty and lists exceptions; it does not determine insurance response. [Chapter 1. Lawyer-Client Relationship](https://www.calbar.ca.gov/legal-professionals/rules/rules-professional-conduct/current-rules-professional-conduct/chapter-1-lawyer-client-relationship)
