# Insurance Buying Guide for Housing and Real Estate Businesses

[Real Estate and Construction](https://spot.insure/industries/real-estate-and-construction)

Separate the landlord, third-party manager, and platform roles. List each building’s owner, occupancy, rent exposure, and property held for others; identify who leases and manages it. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

## Which Insurance Should You Consider?

Consider commercial property, general liability, professional errors and omissions (E&O), cyber liability, workers’ compensation, and builders risk. Start with the coverages tied to your day-to-day operations, then use the situations and buying questions below to compare your options.

### [Commercial property](https://spot.insure/coverage/commercial-property)

**When it matters:** Your entity owns rental buildings or manages sites with tenant or client property. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**What to review:** If proposed terms include ordinance-or-law coverage, ask which costs enforcement of building, zoning, or land-use law can trigger. Coverage C requires replacement-cost coverage. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**Ask:** Which entity owns each building, collects rent, and is named insured? How are the structure, systems, equipment, tenant improvements, and property held for others listed and valued? What rent trigger, period, deductibles, and ordinance terms apply? [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

### [General liability](https://spot.insure/coverage/general-liability)

**When it matters:** Residents, tenants, vendors, or visitors enter buildings you own or manage, or your staff inspect and maintain them. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**What to review:** Ask whether the locations, tenant and vendor visits, and maintenance work are described, and which exclusions and limits apply. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**Ask:** Which owner and manager entities, addresses, and premises activities appear in the application? [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

### [Professional errors and omissions (E&O)](https://spot.insure/coverage/professional-errors-omissions)

**When it matters:** You manage property for clients, provide leasing or valuation services, or operate a platform for listings, leases, or resident requests. [Small Business](https://content.naic.org/consumer/small-business.htm)

**What to review:** Describe each service and platform function. Ask which proposed professional form addresses alleged errors in those services; check software-related terms in the actual form. [Small Business](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which services, software functions, client contracts, insured entities, defense costs, and exclusions are listed? [Small Business](https://content.naic.org/consumer/small-business.htm)

### [Cyber liability](https://spot.insure/coverage/cyber)

**When it matters:** A housing marketplace or management platform stores tenant or owner data, processes rent, or depends on online access and payment systems. [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Small Business](https://content.naic.org/consumer/small-business.htm)

**What to review:** List data, payment flow, vendors, and downtime dependencies. Ask how the quote treats response costs, interruption, and exclusions. [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Small Business](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which systems, data, payment events, dependent services, response costs, and privacy claims are included or sublimited? [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Small Business](https://content.naic.org/consumer/small-business.htm)

### [Workers’ compensation](https://spot.insure/coverage/workers-compensation)

**When it matters:** You hire leasing, maintenance, inspection, or property operations staff. [Small Business](https://content.naic.org/consumer/small-business.htm)

**What to review:** Ask whether the policy addresses employees’ work-related injury or illness and check requirements where they work. [Small Business](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which locations, duties, payroll, classifications, and state requirements appear in the application and policy? [Small Business](https://content.naic.org/consumer/small-business.htm)

### [Builders risk](https://spot.insure/coverage/builders-risk)

**When it matters:** An owned or managed building enters renovation, unit additions, or systems work before occupancy. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**What to review:** Share project parties, contract, existing building, work in progress, and schedule. Ask when the proposed form starts and ends. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**Ask:** Who owns the building and work, and which owner, manager, or contractor is listed at each phase? What property, values, exclusions, milestones, and dates appear? [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

[Book a Free Consultation](https://cal.com/team/spotinsure/insurance-consultation)

## Separate Owners, Managers, and Platforms

For each address, list the owner, manager, occupancy, lease entity, and rent collector. Identify who owns installed systems, equipment, tenant improvements, and property held for others; ask how each interest is valued and listed. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

Managers should separate client buildings and agreements from property their company owns, then list leasing, rent collection, repairs, and tenant requests. Platforms should list their tools, contracts, data, and customer promises in professional-liability and cyber applications. [Small Business](https://content.naic.org/consumer/small-business.htm), [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity)

## Plan Rent and Renovation Handoffs

Before renovation, share the project contract, parties, existing structure, work in progress, values, and dates. Ask how the proposed builder’s-risk form lists owners, managers, and contractors by phase and when it starts or ends. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

Ask whether the building qualifies for the NFIP General Property Form. It lists non-residential buildings, residential buildings with five or more families, and condominiums with more than 25% non-residential occupants. Building and contents are separate. For this form, business-interruption and loss-of-use financial losses are excluded. Confirm eligibility and policy terms. [National Flood Insurance Program Summary of Coverage: Commercial Property](https://agents.floodsmart.gov/sites/default/files/media/document/2025-07/fema-nfip-summary-of-coverage-commercial-property-brochure-01-2024.pdf)

## Common Questions

### What should I send when an owner hires a property manager?

Share the management agreement, address, occupancy, and each entity’s duties. Ask how proposed forms list the owner’s building interest, manager’s services, and property held for others.
