# Does calling a company fintech mean it has to buy a particular policy?

No. A fintech label does not determine a purchase. Check which rules apply to the company’s activity and jurisdiction, then review any separate condition in a signed bank or customer contract. [FTC Safeguards Rule: What Your Business Needs to Know](https://www.ftc.gov/business-guidance/resources/ftc-safeguards-rule-what-your-business-needs-know), [Agencies Issue Final Guidance on Third-Party Risk Management](https://occ.treas.gov/news-issuances/news-releases/2023/nr-ia-2023-53.html)

Separate a law or regulator rule from a signed counterparty requirement. Ask the counterparty which entity, coverage type, limit, wording, and proof it wants, then confirm the requirement against the actual agreement. Give the broker the exact activity and clause and ask whether the proposed form addresses the obligations you have accepted. Neither a regulatory category nor a policy name proves a claim is covered.
