# Insurance for Education Organizations

[Industries](https://spot.insure/industries)

An education organization’s quote should reflect its role: a school or campus operator has people, premises, property, and activities to describe, while an education technology vendor may handle student information and deliver services a school relies on. Map the legal entities, services, data, vendors, locations, staff, and customer contract terms, then ask the broker which forms and exclusions apply to each part of the operation. [Small Business](https://content.naic.org/consumer/small-business.htm), [Who is a “school official” under FERPA?](https://studentprivacy.ed.gov/faq/who-school-official-under-ferpa), [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity)

## Which Insurance Should You Consider?

Consider cyber liability, professional errors and omissions (E&O), general liability, commercial property, workers’ compensation, and commercial auto. Start with the coverages tied to your day-to-day operations, then use the situations and buying questions below to compare your options.

### [Cyber liability](https://spot.insure/coverage/cyber)

**When it matters:** Your software, learning platform, school, or campus service stores student, family, employee, or customer information, including data held by a cloud or technology vendor. [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Small Business](https://content.naic.org/consumer/small-business.htm)

**What to review:** Use a data map to explain what you collect, where it is stored, who can access it, which vendors handle it, and how a security event could interrupt service. FTC and NAIC guidance offers cyber insurance questions, but it does not establish what a particular policy covers. [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Small Business](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which first-party response costs, third-party claims, vendor events, data restoration, notification, interruption, and regulatory expenses are defined in the proposed form, and what exclusions, retentions, waiting periods, and sublimits apply? [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Small Business](https://content.naic.org/consumer/small-business.htm)

### [Professional errors and omissions (E&O)](https://spot.insure/coverage/professional-errors-omissions)

**When it matters:** Customers rely on your instruction, curriculum, assessment, implementation, consulting, or other professional service to make education or operating decisions. [Small Business](https://content.naic.org/consumer/small-business.htm), [Launch your business](https://www.sba.gov/counseling/launch-your-business/)

**What to review:** Describe each service and the deliverable a customer relies on. General professional liability guidance is not a definition of technology E&O; if you provide hosted software, integrations, or ongoing services, ask the insurer which services the proposed form treats as professional services and what separate terms apply. [Small Business](https://content.naic.org/consumer/small-business.htm), [Launch your business](https://www.sba.gov/counseling/launch-your-business/)

**Ask:** Are the named education services and deliverables included in the definition of professional services? How does the proposed form address a service error, missed deliverable, or customer financial loss, and which exclusions or limits apply? [Small Business](https://content.naic.org/consumer/small-business.htm), [Launch your business](https://www.sba.gov/counseling/launch-your-business/)

### [General liability](https://spot.insure/coverage/general-liability)

**When it matters:** You operate a school, tutoring site, lab, event, or campus service where students, families, customers, contractors, or other visitors may be present. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**What to review:** List the locations and activities that bring people onto the premises or place your staff at another site. NAIC and California Department of Insurance guidance describe general commercial liability as a distinct line; neither establishes how a particular school activity is treated by a policy. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**Ask:** Which premises, events, field activities, and services are described in the application? Which bodily-injury or property-damage claims, exclusions, limits, and locations appear in the proposed form? [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

### [Commercial property](https://spot.insure/coverage/commercial-property)

**When it matters:** You lease or own a classroom, office, lab, residence, or campus site, or keep computers, lab equipment, furniture, inventory, or records there. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**What to review:** Separate your building interest from equipment, contents, and property belonging to a school, customer, or another organization. Property terms depend on the scheduled interests, locations, values, covered causes of loss, and policy wording. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**Ask:** Which buildings, contents, equipment, and other parties’ property are scheduled at each location? What valuation basis, deductibles, exclusions, off-premises terms, and interruption triggers apply? [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

### [Workers’ compensation](https://spot.insure/coverage/workers-compensation)

**When it matters:** You hire teachers, instructors, campus staff, lab workers, or other employees, including people who work remotely or across state lines. [Small Business](https://content.naic.org/consumer/small-business.htm), [Employer information](https://www.dir.ca.gov/dwc/employer.htm)

**What to review:** Give the broker the states where people work, their duties, and payroll information. California’s Division of Workers’ Compensation says employers generally must carry workers’ compensation even with one employee; check its exceptions and confirm requirements with each other state’s authority. [Small Business](https://content.naic.org/consumer/small-business.htm), [Employer information](https://www.dir.ca.gov/dwc/employer.htm)

**Ask:** Which work states, employee duties, and classifications are shown on the quote? How are remote staff, instructors, lab duties, and any separate employers-liability terms handled? [Small Business](https://content.naic.org/consumer/small-business.htm), [Employer information](https://www.dir.ca.gov/dwc/employer.htm)

### [Commercial auto](https://spot.insure/coverage/commercial-auto)

**When it matters:** Your organization owns, leases, or rents vehicles, or staff drive for school, campus, event, student, or customer activities. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**What to review:** List owned and rented vehicles, regular business uses, and any employee use of personal vehicles. Commercial auto terms depend on the actual policy and vehicle use; a general liability limit does not answer the vehicle question. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**Ask:** Which vehicles, drivers, states, passenger or delivery uses, and employee-owned vehicles are included, and what liability, physical-damage, and exclusion terms apply? [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

[Book a Free Consultation](https://cal.com/team/spotinsure/insurance-consultation)

## Map the School and Vendor Roles

Write down which entity operates each school, campus, software service, clinic, or contracted program. If a school shares education records with a vendor under FERPA’s school-official exception, Department of Education guidance says the vendor’s service, control over record use and maintenance, permitted uses, and the school’s notice criteria matter. That exception applies to its stated circumstances; it is not a rule for every institution or every student data set. [To which educational agencies or institutions does FERPA apply?](https://studentprivacy.ed.gov/faq/which-educational-agencies-or-institutions-does-ferpa-apply), [Who is a “school official” under FERPA?](https://studentprivacy.ed.gov/faq/who-school-official-under-ferpa)

For the quote, identify who owns the customer relationship, who operates the service, and which entity employs the people doing the work. Give the broker the customer agreement and a clear description of each entity’s services so the proposal can be checked against the actual operation. [Small Business](https://content.naic.org/consumer/small-business.htm), [Launch your business](https://www.sba.gov/counseling/launch-your-business/)

## Trace Student Data Through the Service

Inventory the information your service collects, who can access it, where it goes, which vendors store or process it, and what the customer agreement says about use, return, and deletion. For a FERPA-covered school using the school-official exception, Department guidance identifies direct school control and limits on use and redisclosure as relevant conditions. [Who is a “school official” under FERPA?](https://studentprivacy.ed.gov/faq/who-school-official-under-ferpa), [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity)

Bring that map to a cyber quote discussion. Ask whether the proposed terms address your vendor-held data, response costs, third-party claims, and interruption scenarios. The FTC’s small-business guide presents these as questions to discuss with an agent; it does not say a standard policy includes each item. [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Small Business](https://content.naic.org/consumer/small-business.htm)

## Match Sites, People, and Services to the Quote

Before requesting terms, list classrooms, offices, labs, residences, events, equipment, vehicles, and employee work states. Tell the broker when your team teaches, advises, installs software, hosts a platform, operates a lab, or transports people; one business description may involve several distinct activities. [Small Business](https://content.naic.org/consumer/small-business.htm), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm), [Launch your business](https://www.sba.gov/counseling/launch-your-business/)

When a customer requests insurance evidence or specific wording, compare the request with the proposed forms and endorsements for the named entity, service, and site. Ask the insurer or broker to identify the terms that address the request and any part they do not address. [Launch your business](https://www.sba.gov/counseling/launch-your-business/), [Small Business](https://content.naic.org/consumer/small-business.htm)

## Common Questions

### What should an education technology vendor share before requesting a cyber quote?

Share a practical map of the information the service collects, where it is stored, who can access it, which vendors handle it, and the customer’s limits on its use. For a school relying on FERPA’s school-official exception, Department guidance specifically identifies the vendor’s service and the school’s control over record use and maintenance. [Cybersecurity for Small Business](https://www.ftc.gov/business-guidance/small-businesses/cybersecurity), [Who is a “school official” under FERPA?](https://studentprivacy.ed.gov/faq/who-school-official-under-ferpa)

[Read the full answer](https://spot.insure/industries/education/what-to-share-for-student-data)
### Does FERPA tell you which insurance a school or vendor should buy?

The Department of Education’s FERPA guidance explains when a school-official exception may allow a covered institution to disclose education records to an outside provider and what control and use conditions apply. It does not define an insurance policy’s coverage; describe the data and service to the broker, then review the actual forms.
