# Insurance Buying Guide for Consumer Finance Businesses

[Fintech](https://spot.insure/industries/fintech)

Before shopping, list whether the company originates accounts, services loans, collects payments, handles consumer data, or reports information to a consumer reporting agency. Put the company’s role and jurisdiction in the underwriting description, then ask the insurer what the actual forms say about those activities. [FTC Safeguards Rule: What Your Business Needs to Know](https://www.ftc.gov/business-guidance/resources/ftc-safeguards-rule-what-your-business-needs-know), [Consumer Reports: What Information Furnishers Need to Know](https://www.ftc.gov/business-guidance/resources/consumer-reports-what-information-furnishers-need-know)

## Which Insurance Should You Consider?

Consider professional errors and omissions (E&O), cyber liability, crime, employment practices liability, and general liability. Start with the coverages tied to your day-to-day operations, then use the situations and buying questions below to compare your options.

### [Professional errors and omissions (E&O)](https://spot.insure/coverage/professional-errors-omissions)

**When it matters:** You originate or service accounts, administer payments, provide credit counseling, or make decisions for a financial product. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [FTC Safeguards Rule: What Your Business Needs to Know](https://www.ftc.gov/business-guidance/resources/ftc-safeguards-rule-what-your-business-needs-know)

**What to review:** Describe each service and allegation separately. The generic E&O explanation is not a consumer-finance policy interpretation; ask what the proposed form says about account errors, service duties, statutory claims, and regulatory inquiries. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [FTC Safeguards Rule: What Your Business Needs to Know](https://www.ftc.gov/business-guidance/resources/ftc-safeguards-rule-what-your-business-needs-know)

**Ask:** Which named professional services, entities, alleged errors, financial-services exclusions, and defense-cost terms appear in the actual wording? [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [FTC Safeguards Rule: What Your Business Needs to Know](https://www.ftc.gov/business-guidance/resources/ftc-safeguards-rule-what-your-business-needs-know)

### [Cyber liability](https://spot.insure/coverage/cyber)

**When it matters:** Your platform holds borrower applications, identity data, account credentials, or information handled for a financial institution. [16 CFR § 314.2 — Definitions](https://www.ecfr.gov/current/title-16/chapter-I/subchapter-C/part-314/section-314.2), [Insurance Topics | Cybersecurity](https://content.naic.org/insurance-topics/cybersecurity)

**What to review:** FTC definitions and jurisdiction matter to information-security rules, while cyber terms vary by policy. Ask how the quote treats your own data, data handled for partners, vendors, response costs, and interruption. [16 CFR § 314.2 — Definitions](https://www.ecfr.gov/current/title-16/chapter-I/subchapter-C/part-314/section-314.2), [Insurance Topics | Cybersecurity](https://content.naic.org/insurance-topics/cybersecurity)

**Ask:** Does the quote address borrower application and identity data, partner-held information, service-provider incidents, response costs, and interruption? Which sublimits, waiting periods, and exclusions apply? [16 CFR § 314.2 — Definitions](https://www.ecfr.gov/current/title-16/chapter-I/subchapter-C/part-314/section-314.2), [Insurance Topics | Cybersecurity](https://content.naic.org/insurance-topics/cybersecurity)

### [Crime](https://spot.insure/coverage/crime)

**When it matters:** The company receives payments, changes bank details, issues disbursements, or gives employees account access. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**What to review:** Crime is distinct from professional-service and cyber questions. Ask whose property is insured and how the form treats authorized persons, fraudulent instructions, payment methods, and direct-loss conditions. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

**Ask:** Whose property is insured, and which people, instructions, transfer methods, discovery terms, direct-loss conditions, and exclusions apply? [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

### [Employment practices liability](https://spot.insure/coverage/employment-practices)

**When it matters:** Hiring or a growing collections, servicing, or support team creates new employer and management exposures. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**What to review:** Employee-related claims are distinct from the general-liability categories described by NAIC. Ask who is an insured employer and what allegations, workers, and defense terms the quoted form includes. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which employing entities, worker groups, allegations, defense-cost terms, and exclusions appear in the proposed form? [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

### [General liability](https://spot.insure/coverage/general-liability)

**When it matters:** You operate customer-facing offices, invite visitors, or sell a physical product with the financial service. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**What to review:** Use general liability to review premises and physical injury or property-damage scenarios. Keep borrower complaints, data, account servicing, and money movement as separate quote questions. [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

**Ask:** Which premises, operations, products, and completed work are described, and what bodily-injury or property-damage exclusions and limits apply? [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm), [Small Business Insurance](https://content.naic.org/consumer/small-business.htm)

## List the Services Customers Actually Receive

Describe whether customers apply for credit, open accounts, receive servicing, make payments, or get collection or counseling services. The FTC lists examples such as finance companies, lenders, account servicers, and collection agencies within its Safeguards Rule discussion, subject to FTC jurisdiction and rule definitions. The examples are not a complete license list or a classification decision for your business. [FTC Safeguards Rule: What Your Business Needs to Know](https://www.ftc.gov/business-guidance/resources/ftc-safeguards-rule-what-your-business-needs-know)

Send the broker the customer terms and partner agreements that allocate servicing, complaint handling, notice, and data duties. Ask which duties the insurer wants described and how the actual form treats assumed contractual obligations. [Agencies Issue Final Guidance on Third-Party Risk Management](https://occ.treas.gov/news-issuances/news-releases/2023/nr-ia-2023-53.html)

## Keep Data and Credit-Reporting Scenarios Distinct

If the company handles information for a financial institution, ask counsel to review the complete rule, regulator allocation, data access, and vendor role. The eCFR definition describes customer information handled or maintained by or on behalf of a financial institution; it does not decide the processor’s status from vendor status alone. [16 CFR § 314.2 — Definitions](https://www.ecfr.gov/current/title-16/chapter-I/subchapter-C/part-314/section-314.2)

If you furnish consumer account data to a consumer reporting agency, identify who furnishes, which records are sent, and who investigates disputes. FTC guidance describes accuracy and certain dispute duties for covered furnishers. Do not assume every servicer furnishes data or that insurance pays for corrections or regulatory action. [Consumer Reports: What Information Furnishers Need to Know](https://www.ftc.gov/business-guidance/resources/consumer-reports-what-information-furnishers-need-know)

## Compare the Claim Wording, Not Just the Line Names

Ask the broker to map a servicing error, borrower dispute, security event, fraudulent payment instruction, and office injury to the actual forms. Record which entity is named, what claim or event triggers the policy, and which exclusions, limits, conditions, and reporting rules apply. [Small Business Insurance](https://content.naic.org/consumer/small-business.htm), [Insurance Topics | Cybersecurity](https://content.naic.org/insurance-topics/cybersecurity), [Commercial Insurance Guide](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/09-comm/commercialguide.cfm)

NAIC says cyber policies are customized and most commercial property and general-liability policies do not cover cyber risks. Use that general warning to request exact wording for the systems and information involved. [Insurance Topics | Cybersecurity](https://content.naic.org/insurance-topics/cybersecurity)

## Common Questions

### Does every loan servicer have credit-reporting duties?

The FTC Furnisher Rule guide addresses people that furnish consumer information to a consumer reporting agency and certain covered disputes. It does not say every servicer furnishes data. [Consumer Reports: What Information Furnishers Need to Know](https://www.ftc.gov/business-guidance/resources/consumer-reports-what-information-furnishers-need-know)

[Read the full answer](https://spot.insure/industries/consumer-finance/does-every-servicer-have-furnisher-duties)
### Does a cyber policy answer every customer complaint after a data incident?

A cyber label is not enough to answer this. NAIC says these policies are highly customized, so compare the actual forms and ask about each event separately. [Insurance Topics | Cybersecurity](https://content.naic.org/insurance-topics/cybersecurity)
