# Do I Need Insurance for Uber Black in Ontario?

Yes. Uber requires Black drivers to be commercially licensed and insured, and says it does not maintain Black/SUV insurance. Toronto’s specific requirements include commercial vehicle insurance and limousine licensing. Arrange the policy for your actual operation; ordinary Uber fleet limits do not establish Black cover.

Research checked: 2026-10-27. Amounts are USD in the U.S. and CAD in Canada.

## Start With Commercial Black Insurance

### Uber Black Requires Your Own Commercial Insurance

Uber’s Canadian insurance page expressly requires professional limousine drivers providing Black trips to have commercial licensing and commercial insurance. It says Uber does not maintain insurance for Uber Black and Uber SUV because the drivers must maintain their own commercial insurance. This is the starting point for the purchase discussion. Give the insurer the actual Black operation, passenger work, vehicles, drivers, ownership, territory and other business activities. Obtain the commercial automobile policy and the necessary endorsements before relying on an app account. A personal insurance card, a black luxury car or an ordinary ridesharing summary does not establish the required commercial protection for this work.

Public platform rules, legislation and blank standard forms do not authenticate an individual commercial policy, current endorsements, permit or claim. Checked 2026-10-27.

### Uber’s Toronto Black Page Gives Specific Local Requirements

The Canadian Black page reviewed here actually displays Toronto-specific instructions. It requires a valid limousine chauffeur licence and limousine plate from an Ontario municipality, and describes $2 million commercial vehicle insurance for bodily injury or death, accident property damage and third-party liability when obtaining the plate. It also requires the driver’s name or the limousine brokerage or service-company name on the insurance document. Keep this platform requirement and its Toronto context explicit. It does not authenticate every municipality’s current requirements or the individual policy. The document-upload name also needs to be reconciled with the actual named insured, registered owner, business and covered drivers under the insurer’s contract.

### Resolve the Actual Commercial Policy and Its Full Operating Schedule

This guide establishes public requirements and decision points, rather than authenticating one commercial policy for every Black driver. Ask the insurer: Which current insurer-issued commercial auto policy and endorsements cover my actual Uber Black driver, automobile, business and full operating schedule? Public platform rules do not authenticate my individual limits, deductibles, benefits or exclusions. Check the issued certificate, policy wording, schedules and amendments together. Specify whether the car is used for app requests, prearranged private work, other platforms, personal journeys or more than one business. The relevant contract can have different permitted uses and conditions from a standard form or another operator’s policy. The checker therefore keeps commercial coverage qualified and supplies the questions needed to resolve it, rather than assigning an unverified fleet schedule to the driver.

### The Ordinary Uber Fleet Policy Does Not Establish Black Cover

Uber’s Canadian page separates the Black commercial requirement from its ordinary provincial fleet tables. The current public Ontario fleet packet also defines ridesharing to exclude taxicab and commercially licensed limousine or livery services. FSRA’s approved ridesharing list names the Uber program, but that listing does not establish Black’s independently arranged commercial policy. This matters when a commercial Black operation accepts an economy request: choosing another product does not itself change the insured operating category. Uber’s Toronto Black page permits certain other requests where eligible. Resolve the commercial insurer’s response to those activities expressly; do not transfer the ordinary fleet’s waiting limit, accepted-trip limit, repair deductible or benefits to a commercially licensed car.

### Discuss Personal Use Within the Actual Commercial Arrangement

A commercial automobile policy needs to address the uses you actually make of the car, including personal driving, repositioning, travel to a booking, waiting, passenger carriage and any other business work. Buying a second personal policy should not be assumed to be the universal answer; first ask the insurer which contract and endorsements permit each activity. Ontario’s Compulsory Automobile Insurance Act separately requires the owner or lessee not to operate, or permit operation of, an uninsured motor vehicle on a highway. FSRA’s consumer duties also call for accurate information and notice of changes. Keep the insurer’s written permitted-use answer instead of treating an app preference or a label on a card as the complete insurance arrangement.

## Toronto Licensing, Insurance Limits and Certificates

### The Ordinary Provincial Minimum Is Not the Toronto Black Requirement

Insurance Act section 251 sets an ordinary automobile liability minimum of $200,000 per accident, excluding interest and costs. That statutory floor does not describe all the insurance required for a professional Black operation. Uber’s Toronto Black instructions and Toronto’s posted limousine-owner provisions address substantially larger local protection and specific commercial use. Determine the actual municipality, vehicle category and operating permissions, and consider any additional contractual requirements from clients or counterparties. Do not generalize Toronto’s local amount to every province or assume meeting the smallest ordinary legal limit is sufficient. A liability amount also says little about repairs, benefit selections, permitted drivers or the business actually insured.

### Toronto’s Posted Code Requires Limousine Automobile Insurance

Section 546-75 of Toronto’s posted code requires a limousine owner to ensure each limousine has at least $2 million automobile insurance, exclusive of interest and costs, for the specified bodily injury, death, accident property damage and liability protection. It requires a certificate deposited with Municipal Licensing and Standards and an endorsement giving at least 30 days’ written notice of cancellation, expiry or variation in the amount. The reviewed consolidation is dated June 27, 2024, so retain that date and check current licensing instructions and amendments. A public code provision identifies a duty; it is not proof that a particular owner filed a satisfactory certificate or remains licensed and insured.

Public platform rules, legislation and blank standard forms do not authenticate an individual commercial policy, current endorsements, permit or claim. Checked 2026-10-27.

### The Current Owner Webpage and Vehicle Form Use Different Labels

Toronto’s limousine-owner webpage, modified September 8, 2026, calls its $2 million requirement Commercial General Liability (PL/PD). Its linked certificate is a taxi/limousine vehicle-owner insurance form, and the posted code provision specifically describes automobile insurance. Preserve that difference instead of silently treating the labels as interchangeable or declaring an additional policy purchased. Ask the insurer and licensing authority which automobile and any separate general-liability evidence they require for the actual licence. The question is material because a general-liability certificate does not itself establish paying-passenger automobile protection. Uber’s Toronto page separately uses commercial vehicle insurance wording for the limousine plate requirement.

Public platform rules, legislation and blank standard forms do not authenticate an individual commercial policy, current endorsements, permit or claim. Checked 2026-10-27.

### A Blank City Certificate Is a Filing Template

The City’s linked 2023 certificate form identifies the taxi/limousine vehicle-owner licence, insured name matching registration, vehicles, insurer, policy number, amount and effective and expiry dates. Its text references OPCF 6A and code sections 546-55 and 546-75, calls for insurer authorization, and addresses advance notice and a substitution endorsement when vehicles change. Those fields explain what a filing must identify; the blank form is not insurance and does not prove the policy is in force. The current owner page also instructs the insurer to send signed and stamped completed forms directly to the City. An uploaded copy accepted by the app does not establish completion of that separate municipal process.

Evidence: Company-reported. Scope: Ontario Uber Black commercial owner-driven car research, with Toronto-specific licensing/limits identified expressly. Public platform rules, legislation and blank standard forms do not authenticate an individual commercial policy, current endorsements, permit or claim. Checked 2026-10-27.

### A Chauffeur Licence, Vehicle Licence and PTC Approval Are Separate

Uber’s Toronto Black instructions distinguish the limousine chauffeur licence from the Ontario driver’s licence and require a valid limousine plate. The posted code separately requires an owner licence for each limousine and restricts operation to a licensed vehicle-for-hire driver. Uber also describes standard PTC requirements in addition to its Black-specific documents. Toronto’s PTC driver guidance says the PTC submits the application, approved training is required for new applicants and separate licences are needed for separate PTCs. Establish each actual permission rather than assuming one licence replaces the others. The policy must still name or define the correct driver, vehicle and use; licensing paperwork alone does not amend it.

Public platform rules, legislation and blank standard forms do not authenticate an individual commercial policy, current endorsements, permit or claim. Checked 2026-10-27.

### The PTC Company’s CGL Requirement Has Its Own Scope

Toronto’s company licensing page requests a $5 million CGL certificate for the private transportation company, and the posted code treats that corporate business obligation separately from the automobile insurance for vehicles. An individual Black driver does not become the PTC merely by receiving its requests. Conversely, someone operating a separate transportation business may have additional obligations beyond being a driver or vehicle owner. Identify which legal entity holds each licence and which policy protects it. Do not copy the platform company’s CGL amount into an ordinary driver’s auto limit, or treat the limousine-owner webpage’s different insurance label as proof that the company and owner obligations are the same.

### A Vehicle Inspection Does Not Replace the Insurance Review

Uber’s Toronto Black page requires an annual inspection and timely submission of the Safety Standards Certificate. Toronto’s owner instructions separately address inspection documents, registration matching the applicant and approved limousine vehicles. Ontario’s registration guidance requires valid insurance and vehicle documents. Keep the actual vehicle identity consistent across the registration, plate, inspection, app and insurer schedule, especially after replacement or a business ownership change. A roadworthy car can still have an insurance-use problem, and an insured car can still fail a local licensing requirement. Check the current instructions for the actual city and vehicle rather than using the insurance certificate to answer every inspection or operating-permission question.

## Paying-passenger Permission and Commercial Policy Scope

### The Standard Owner’s Policy Needs the Relevant Permission

The posted OAP 1 section 1.8.1 generally excludes the specified taxicab, bus, sightseeing and paying-passenger uses, subject to its stated accident-benefit qualification and exceptions. Commercial liability limits alone do not remove that language. Obtain the actual endorsement or insurer-approved wording permitting your professional passenger operation and verify the described automobile, business and dates. The City’s vehicle-owner certificate references OPCF 6A; that reference is not proof the endorsement was issued for your car. FSRA also publishes other public-passenger forms with different structures. The relevant question is which permission and conditions are actually part of your contract, rather than whether a public form or a high liability number exists.

Public platform rules, legislation and blank standard forms do not authenticate an individual commercial policy, current endorsements, permit or claim. Checked 2026-10-27.

### OPCF 6C Has Fields for Passenger and Property Limits

FSRA’s current listing provides the 2024 OPCF 6C public-passenger form. It gives the stated paying-passenger permission and includes fields for specified occupant injury and carried-property limits, with alternative limit structures. It says those limits replace the corresponding certificate limits for the described exposures and are additional to limits for injury to other persons. Because the public template’s dollar fields are blank, it establishes no particular operator’s passenger limit. Examine the populated issued endorsement with the declarations and licensing requirements. Do not fill its blanks with the ordinary provincial minimum, a different platform’s fleet amount or the highest number appearing elsewhere in the policy.

Evidence: Verified. Scope: Ontario Uber Black commercial owner-driven car research, with Toronto-specific licensing/limits identified expressly. Public platform rules, legislation and blank standard forms do not authenticate an individual commercial policy, current endorsements, permit or claim. Checked 2026-10-27.

### OPCF 6F and 6C Can Change the Carried-property Exclusion

The regulator’s 2024 OPCF 6F is a separate combined-limits public-passenger form. Both that form and OPCF 6C replace the stated section 3.5.1 liability limitation for carried property during the described use, with a qualification involving DCPD and its election, while retaining the stated exclusion for other property owned or rented by insured persons. This matters when discussing a passenger’s damaged luggage: quoting only the unamended OAP 1 exclusion can miss an applicable change form. Equally, neither public template proves it was purchased or covers every allegation. Ask which issued endorsement, property interest, deductible, liability and other terms apply to the actual damaged item.

### A Form Library Is Not an Individual Policy Schedule

The public-passenger forms identify the insured, policy number, effective change date and automobile or schedule to which they apply, and preserve other policy terms except as changed. A downloaded blank copy does not complete those fields or prove attachment. FSRA’s forms directory also explains that active older FSCO forms have been transferred and that assistance is available for older versions. The current forms examined here should not be treated as proof that every older municipal reference has been replaced or every insurer uses identical terms. Obtain the issued permission and ask the insurer and licensing authority to explain any mismatch in form names or required evidence for your actual operation.

### Match the Business, Registered Owner and Covered Drivers

Uber’s document instructions allow a driver, limousine brokerage or service-company name to appear on the insurance document. Toronto’s owner instructions require vehicle registration matching the applicant, with specific treatment for partnerships and corporations. Reconcile those administrative requirements with the policy’s named insured, ownership, permitted drivers and business description. A company and its owner are not interchangeable names for every insurance purpose. Tell the insurer about employed or substitute chauffeurs, relevant vehicle changes and the entity accepting private bookings. Ask for the actual schedule or endorsement showing how each person and automobile qualifies rather than assuming that permission to upload a company document establishes every individual’s protection.

### Check Waiting, Repositioning, Private Bookings and Other Apps

Uber does not publish a Black fleet policy with one waiting, accepted-trip and offline schedule in the Canadian material reviewed. Its Toronto page says a Black driver may choose some other product requests where eligible; that is app functionality, not an insurer’s agreement to every activity. Ask how your own commercial policy treats waiting, travel to pickup, passenger carriage, repositioning, return travel, private clients, other platforms and personal use. State the real operating territory and any cross-border work. A policy arranged around one business description should not be presumed suitable for materially different work. Keep the insurer’s written response and applicable changes before relying on an app preference as insurance evidence.

### Borrowed, Rented and Fleet Vehicles Need Separate Review

Uber’s Toronto instructions say a driver need not own the vehicle, but platform eligibility does not establish the driver’s protection under someone else’s commercial policy. Rentals, leases, fleet operators and substitute cars raise separate permission, named-insured, vehicle-schedule and physical-damage questions. The standard OAP 1 describes different automobile categories and conditions; it is not a universal commercial rental endorsement. Obtain the actual agreement and insurance for the arrangement, including permission for the intended passenger work. This checker’s reviewed commercial owner-driven car scope is withheld for borrowed, rented and non-car selections. The broader discussion identifies what to investigate, rather than certifying those arrangements as equivalent to an owned car.

## Repairs, DCPD, Finance and Business Losses

### The Commercial Liability Limit Does Not Purchase Car Repairs

FSRA distinguishes collision, comprehensive, specified perils and all-perils protection from automobile liability. A commercial policy permitting Black work can still have different purchased physical-damage options, exclusions and deductibles. There is no Black repair deductible authenticated by Uber’s Canadian commercial rule. The ordinary Uber fleet’s contingent-repair conditions and deductible should not be inserted into your own contract. Ask the broker to identify the actual automobile, permitted use, purchased perils, insured value and deductible for each type of loss. A description such as full coverage is too vague to establish whether the car is insured for a particular collision, theft, vandalism or other event.

### DCPD Is a Distinct Qualified Repair Route

Insurance Act section 263 and OAP 1 section 6 govern qualified Ontario direct-compensation property-damage claims. Relevant conditions include an Ontario accident and another involved automobile insured by a qualifying insurer, with recovery reflecting the share for which the driver is not at fault. The Fault Determination Rules supply the applicable allocation. Do not turn every partly at-fault collision into an automatic half-payment rule. The balance of damage may need separate collision protection under its terms. Confirm the actual commercial policy’s DCPD deductible and endorsements; a zero deductible shown in an unrelated fleet packet does not establish the same result for a Black operator’s independently arranged policy.

### An OPCF 49 Election Changes More Than a Certificate Label

The approved OPCF 49 permits the specified written election not to recover DCPD damages and warns of losing protection for the car, contents and loss of use even when another driver is responsible. The framework also affects collision availability under the policy concerned. Regulation 664 section 5.2 addresses election and revocation. Establish whether an election actually exists and how it interacts with the issued commercial endorsements, finance requirements and carried-property wording. A blank public form does not prove an election, and the public-passenger forms’ DCPD references deserve examination rather than being ignored. Ask for the signed selection and the insurer’s explanation of the specific consequences for the vehicle and use.

### Compare Actual Cash Value With Finance and Replacement Obligations

The standard OAP 1 vehicle-damage provisions address actual cash value, repair or replacement, depreciation and salvage, subject to the issued policy and endorsements. Your finance balance, original purchase price and cost of a new luxury replacement can differ from the insured settlement. Identify any agreed-value, replacement-cost, gap or other protection actually purchased instead of inferring it from the Black service category. Keep condition, mileage, equipment and valuation evidence. Ask how the deductible and lender or lessor interests affect payment and what remains payable under the finance agreement. Listing a lienholder is not, by itself, a guarantee that every outstanding debt will be discharged after a total loss.

### Paying for a Rental and Using It for Black Are Separate Questions

FSRA’s optional-coverage guidance and OPCF 20 describe replacement transportation under the purchased protection and its conditions. A public endorsement is not evidence that it was added to your commercial policy. The standard OAP 1 also has a limited whole-car theft transportation provision with the stated trigger and cap, rather than universal rental reimbursement after every accident. Separately establish whether a replacement vehicle is licensed, insured and eligible for the intended passenger service. A rental invoice, an insurer’s payment toward it or a temporarily available car does not establish all three. Confirm the applicable rental cost, duration, permitted use and vehicle approval before treating replacement transport as a continuation of the same Black operation.

### Lost Fares and Business Interruption Need Express Protection

A car-repair settlement and a liability policy do not automatically reimburse every day of lost fares, cancelled bookings, operating overhead or replacement-driver expense. The standard automobile form has defined loss-of-use provisions, while accident-related income benefits have separate injury and earnings tests. Describe the actual business exposure to the broker and identify any additional protection actually offered and purchased. If a client contract requires particular insurance, give the insurer the requirement and proposed wording; a certificate should reflect bound coverage rather than create it. Keep private bookings and other apps in the operating description so a policy arranged for one activity is not assumed to insure every source of business revenue.

## Injury Benefits, Insured People and Workplace Coverage

### Read the July 2026 Reform Against the Actual Renewal and Elections

SABS section 2 makes specified categories optional for policies entered into or renewed from July 1, 2026, addresses continuation at renewal unless written changes are agreed, permits stated written changes to earlier contracts, and identifies eligible people for those categories from July 1. A commercial Black driver therefore needs the actual start or renewal date and selected benefits. The reform does not prove that every policy lost all non-medical benefits on one day. FSRA’s reform materials explain the new purchasing structure, while the issued schedule shows what was selected. Do not import another fleet’s published September benefit package into an independently arranged Black policy or assume an older standard-benefits summary resolves current selections.

### Medical Limits Depend on the Statutory Category and Purchased Changes

SABS section 18 distinguishes the $3,500 minor-injury medical-and-rehabilitation framework, with its specified exceptions, from the ordinary combined $65,000 non-catastrophic medical, rehabilitation and attendant-care limit and $1 million catastrophic limit, with applicable HST provisions and optional modifications. These statutory categories are not established by the severity of vehicle damage or the number of passengers. Obtain the medical evidence, actual benefit selections and insurer’s classification for the injured person. A larger commercial liability limit does not automatically increase these benefit ceilings. Ask which expenses, assessments, treatment and enhancements apply under the relevant statute and issued policy rather than treating the largest published number as an automatic entitlement.

### Income Replacement Uses Injury and Earnings Evidence

SABS sections 5 through 7 examine employment or self-employment, disability and the applicable earnings calculation, offsets and purchased weekly limit. The general calculation is not simply the gross fare total shown in an app, and the disability test changes after 104 weeks. Preserve reliable income, expense and medical evidence for the actual business and work relationship. A self-employed owner-driver, an employed chauffeur and a person with other work can have different facts to establish. Neither a damaged commercial car nor a gap in bookings proves the injury test or weekly entitlement. Ask the insurer which selected benefit, income information and deductions it is applying rather than adding a presumed wage benefit to the automobile liability limit.

### A Company Named Insured Does Not Answer Every Driver’s Benefit Question

Current SABS provisions and FSRA’s fleet guidance distinguish named insureds, spouses, dependants, listed drivers and people who may qualify as deemed named insureds under the statutory conditions. A corporation’s name and its director’s personal name are not interchangeable for every benefit. Where a business provides a vehicle, establish the actual use and statutory facts rather than assuming all officers, employees, household members and passengers have identical optional benefits. Keep the insured-person question separate from the company’s commercial liability and vehicle ownership. Ask for a written explanation identifying the policy, eligible person, selected benefit and any priority issue before treating an app profile or company certificate as conclusive.

### A Posted OPCF 47R Is Not Proof of an Actual Priority Election

FSRA’s approved OPCF 47R and guidance address optional benefits, covered people, selections and priority under that endorsement. Its public availability does not establish that your commercial policy contains it or that an individual made the relevant election. Insurance Act section 268 and the SABS provide the applicable priority framework, which must be examined with the actual contract and circumstances. Ask which insurer should receive the application, how a waiver or election operates, and what benefits or offsets apply elsewhere. Several policies do not simply create a right to add every weekly benefit limit together. Retain the issued endorsement and written explanation rather than relying on the title of a downloaded blank form.

### Uninsured Automobile and Family Protection Are Distinct From Repairs

The standard OAP 1 separates uninsured automobile protection from liability and vehicle damage. The approved OPCF 44R family-protection form addresses qualifying injury or death involving an inadequately insured motorist, with definitions, deductions, evidence and multiple-coverage provisions. It does not create an extra collision allowance or an automatic payment equal to a headline limit. Confirm whether it is purchased, which form and limit apply and who qualifies under the actual commercial policy. The public standard form is not evidence of attachment. Identified-uninsured property claims and damage caused by an unidentified car also have different conditions; the phrase hit-and-run should not be used as a substitute for identifying the actual protection and loss.

### Confirm Workplace Status for the Actual Chauffeur Relationship

WSIB’s independent-operator guidance addresses transportation and rideshare work through the applicable status process and actual relationship. It distinguishes an independent operator from an employee and describes vehicle-identification requirements for transportation status rulings. Being commercially insured, incorporated or described as a contractor by a platform does not settle every workplace registration, status or optional-coverage question. Establish whether you are the owner-driver, an employee or engaging other chauffeurs, and ask WSIB about the relevant relationship where needed. Workplace insurance and automobile accident benefits have separate eligibility and coordination rules. Keep the ruling, vehicle information and applicable coverage records, particularly when the work arrangement or car changes.

## Claims, Notice, Valuation and Legal Time Limits

### Report to the Commercial Insurer and Preserve the Work Sequence

Use the incident and claims process specified by your actual commercial insurer and policy, alongside any applicable platform reporting duties. The standard OAP 1 contains written notice provisions with a seven-day period and the stated incapacity qualification. An app report alone does not prove the independent insurer received the necessary notice or documents. Preserve the actual driver, vehicle, booking, request acceptance, passenger pickup and exit, route and other work being performed. These facts can explain the insured activity without creating coverage for an excluded use. Keep proof of receipt and follow the insurer’s evidence requests rather than assuming that a customer-support response is a policy or claim decision.

### SABS Notice and the Completed Application Have Different Triggers

SABS section 32 generally requires notice of an intention to apply within seven days after the circumstances giving rise to entitlement arise, or as soon as practicable after that, and a signed completed application within 30 days after receiving the forms. Section 34 addresses a reasonable explanation for a time-limit failure. Keep the actual forms, requested evidence and receipt records. A commercial-policy certificate, vehicle estimate or app incident number does not replace the injury application. If the insurer disputes timing or an application is late, obtain timely advice about the provision, explanation and facts rather than assuming every late claim is either automatically lost or automatically excused.

### Protect the Car and Distinguish an Estimate From Proof of Loss

The standard OAP 1 statutory conditions require reasonable protection against further damage and specified automobile-loss proof, including the stated sworn declaration within 90 days. They restrict nonessential repairs and destruction of evidence before insurer consent or a reasonable inspection opportunity. Keep photographs taken safely, estimates, condition and ownership records, and the actual work chronology. A preliminary estimate or an app document upload is not necessarily completed proof of loss under the commercial policy. Ask the insurer what remains outstanding and preserve the applicable wording. Insurance Act section 128 provides an appraisal framework for defined disagreements, not an automatic decision on whether a person, vehicle or activity was insured.

### Unidentified-motorist Claims Need Their Specific Evidence

The standard uninsured automobile provisions include particular police-reporting, written-statement and supporting-evidence conditions for unidentified-motorist injury claims, with qualifications. An applicable OPCF 44R adds its own notice, cooperation and corroboration requirements. Establish which form is actually attached and which protection is being claimed. Preserve witnesses and available recordings lawfully without publishing private passenger information. A trip receipt can help demonstrate the work sequence, but it does not replace all motorist, injury or legal evidence. A parking-lot car-damage claim and a serious injury claim involving an unknown driver should not be assumed to have the same coverage route, deductible, conditions or deadline.

### Settlement Procedures and Legal Deadlines Are Different

The standard OAP 1 statutory conditions address payment of money the insurer is liable to pay after proof of loss, with different procedures for appraisal and repair or replacement elections. They also contain distinct action periods for automobile or contents loss and for persons or other property. An applicable family-protection endorsement has its own proceeding language. Examine those provisions with the actual commercial contract, applicable law and any available relief; they are not a promise that every claim closes within a fixed number of days after the accident. Obtain prompt advice about the particular dispute. Ongoing negotiations, an appraisal or a complaint do not themselves prove that a court or tribunal deadline has stopped.

## Choose the Process for the Actual Insurance Issue

### Insurer Priority Has Its Own Procedure

Regulation 283/95 requires an insurer notified of an intention to seek benefits to provide appropriate forms. An insurer supplying the application must not obstruct completion, refuse it or redirect the applicant. The first insurer receiving a completed application must commence benefits in accordance with the SABS while insurer-priority issues are resolved. That procedure does not establish entitlement to every requested benefit or justify inconsistent claims. Keep receipt records and ask which issue is being addressed when referred between insurers. An insurer-to-insurer priority disagreement is different from a dispute about your benefit amount, car valuation or platform account, and should not be used as a reason to lose track of the application and its actual requirements.

### Use the Insurer’s Complaint Officer for the Insurance Complaint

FSRA directs consumers first to the insurance company’s complaint officer and calls for a final position letter. Keep the policy wording, insurer decision, chronology, requested resolution and relevant correspondence. A platform support issue, municipal filing question and insurer complaint may require different channels. Regulatory review does not guarantee compensation, replace the application or preserve every legal deadline. FSRA’s consumer guidance also describes rights and duties in claims handling. Identify whether the issue concerns service, missing evidence, coverage, valuation or benefit entitlement, and send claim or medical information through the appropriate secure process. A single general conversation does not necessarily resolve all of those matters.

### LAT-AABS Is for Accident-benefit Entitlement and Amounts

Insurance Act section 280 and Tribunals Ontario’s LAT-AABS guidance concern statutory accident-benefit entitlement and amounts. LAT-AABS does not determine vehicle damage, fault, pain-and-suffering damages or which insurer has priority. Its guidance generally describes a two-year application period after an insurer’s denial notice and possible extensions. That timeline should not replace different contractual or legal questions affecting automobile property or family-protection proceedings. Obtain prompt advice on the actual denial, loss and limitation issue, including where time may already have passed. A complaint, continued correspondence or an expectation that a commercial insurer will reconsider does not establish that a necessary legal proceeding or tribunal application was filed in time.
