# Do I Need Insurance for Uber Black in California?

Yes. Uber Black requires commercial auto insurance and the permits for your operation. A personal rideshare endorsement is insufficient, and Uber’s ordinary passenger-TNC liability policies do not cover your trips as a commercial driver—even when you accept UberX or Comfort. Match your own policy to the vehicle, drivers and operating authority.

Research checked: 2026-10-27. Amounts are USD in the U.S. and CAD in Canada.

## Start With Your Own Commercial Insurance

### A Personal Rideshare Endorsement Does Not Qualify

Uber Black requires commercial auto insurance. Uber's commercial-driver FAQ distinguishes that requirement from an extension of a personal policy for ordinary rideshare or delivery work: the personal extension is insufficient for its commercial-driver category. Its October 8, 2026 commercial-trip notice also says drivers of commercial vehicles maintain the required auto insurance themselves and Uber does not maintain that coverage. Ask for a policy that expressly covers your paid passenger operation, the actual vehicle and every driver. Describe waiting for requests, traveling to collect a passenger, occupied trips and other business use. A certificate displaying a large number is useful evidence to inspect, but it does not by itself answer whether you, the car and the activity are insured.

Evidence: Company-reported. Scope: California Uber Black commercial passenger operation with an owned car, SUV or van. Fleet, employee, rental and other arrangements need the specifically identified documents; no individual policy, permit, benefit eligibility or claim outcome is established. Checked 2026-10-27.

### Match the Carrier, Insured and Actual Agreement

Keep the operating carrier's legal name, any trade name, TCP authority and the policy's named insured consistent. California's commercial-supplement article asks for the driver or company name on the TCP certificate and a Secretary of State statement where the company holds it. The live U.S. general terms, modified October 12, 2026, preserve separate Platform Access Agreements and Technology Services Agreements, including the priority of relevant conflicting terms in those agreements. Obtain the commercial agreement and insurance disclosures actually applicable to your account. This research did not authenticate your accepted agreement or your issued commercial auto policy. A public platform explanation does not establish that another person's carrier name, agreement or insurance extends to your work.

### Insurance Alone Does Not Qualify the Car for Black

The live Uber Black service page requires a professional driver, commercial auto insurance and the local permits for a commercial livery operation. It separately imposes vehicle and rating criteria. During this review that page displayed a 4.90 minimum rating, while indexed signup material still showed 4.85; use the current requirements for your actual market rather than the older snippet. A commercially insured car can still fail the product's vehicle or account requirements. Before committing to a vehicle or annual policy, check the current eligible-vehicle list and the documents Uber requires for the location. The insurer's permission, regulator's operating authority and platform's vehicle approval answer different questions, and none should be inferred solely from another one.

### Separate Commercial Insurance Costs From Supplement Earnings

Uber's October 2024 California commercial-supplement article describes an earnings opportunity for qualifying commercially licensed and insured drivers in selected markets. It is not a current insurance quote, an assurance that the opportunity is available to your account, or a promise to reimburse your premium. Its footnote expressly distinguishes the supplement from reimbursement for insurance and permit expenses. Ask for the actual annual premium, taxes or fees, installments, deductibles, cancellation terms and any additional-vehicle or driver cost. Compare those expenses with the current offer shown to your account rather than reusing the article's historical mileage example. The article also warns that supplemental earnings enter Proposition 22 top-up calculations, so gross supplement earnings should not automatically be treated as an equal increase in net income.

Fleet, employee, rental and other arrangements need the specifically identified documents; no individual policy, permit, benefit eligibility or claim outcome is established. Checked 2026-10-27.

## California Liability Limits and the Seating-Capacity Discrepancy

### TCP Liability Protection Continues With the Authority

Public Utilities Code section 5391 requires a charter-party carrier to procure and continue liability protection throughout the life of its permit or certificate. It incorporates the passenger-stage minimum framework rather than giving every Black trip the ordinary TNC insurance schedule. Article 4 also specifies the acceptable insurance, bond or authorized self-insurance evidence and addresses how proof is deposited with the Commission. General Order 115-G requires protection in effect and on file before highway operations. Your obligation therefore cannot be reduced to the period when a rider is sitting in the car. Ask the insurer how your commercial policy treats availability, pickup travel, occupied trips, returning between jobs and other uses, and keep the actual coverage and regulatory filing effective throughout the operation.

### Count Designed Seats Including the Driver

The currently linked General Order 115-G, amended March 21, 2024, states ordinary TCP liability tiers by seating capacity including the driver: eight people or fewer, $750,000; nine through fifteen, $1.5 million; sixteen or more, $5 million. Public Utilities Code section 1040, incorporated through section 5391, specifically addresses vehicles designed for at most eight people including the driver. Resolution TL-19147 explains that the amendment was intended to clarify this count. Use the vehicle's actual designed capacity and applicable authority, not the number of passengers on one booking. A larger vehicle does not move into a smaller tier because only two riders board. These are the stated statutory and order requirements, not a determination of the limit in your issued endorsement or any higher contractual requirement.

### Resolve the Eight-Person Endorsement Difference

There is a material discrepancy in the official documents. General Order 115-G places up to eight people including the driver in its $750,000 tier, but the linked March 2024 PL-912 endorsement's page 2 also says the driver is included while placing eight through fifteen people in the $1.5 million tier and seven or fewer in the $750,000 tier. The same mismatch appears between relevant appendices to Resolution TL-19147. Both original tables were visually checked. Do not silently combine their different boundaries or assume that a generic FAQ resolves your insurance contract. For an eight-person vehicle, ask the insurer or broker and CPUC to reconcile the required filing and the actual attached endorsement before relying on a limit. This guide does not substitute an invented uniform boundary for the published conflict.

### Check the Authority Before Using an Exception

General Order 115-G separately lists Class C, TNC and railroad crew-transportation provisions. They do not mean a Black operator can select whichever limit is lowest. CPUC describes Class C authority as transportation incidental to specified balloon, rafting or skiing activities; its separate $750,000 rule is not the general Black-car licensing route. CPUC's authority page describes A and B certificates and the P charter permit, including geographic or vehicle-capacity qualifications. A P permit is limited to vehicles seating fewer than sixteen including the driver. Check what your actual authority permits before adding a larger vehicle or a different service. An insurance certificate, commercial platform account or ordinary TNC permit does not independently expand the services authorized under your own TCP authority.

### Public Protection Does Not Remove Your Policy Duties

PL-912 is a prescribed liability endorsement, not comprehensive insurance for every loss. Its text addresses final judgments for specified bodily injury and property damage and contains exclusions, including particular employee or contractor injury and property owned, rented or carried as cargo. It also says policy terms remain binding between the insured and insurer and includes reimbursement obligations for specified payments the insurer would not otherwise owe. Do not treat the public-protection wording as permission to ignore driver, vehicle or use restrictions. Obtain your issued policy, attached endorsement, declarations and all schedules. Ask how defense costs, deductibles, excess layers and reimbursement provisions work. The uncompleted public form retained for this research is not evidence that a particular insurer issued it to you.

## Keep the Permit, Filing, Vehicles and Drivers Aligned

### An Application or Upload Is Not Active Authority

CPUC's licensing instructions require liability protection on file and identify other operating requirements, including driver-record monitoring, testing and relevant inspections. Uber's California commercial article also lists commercial registration, vehicle insurance proof, the TCP document, its subcarrier acknowledgment and an airport permit where applicable. An application receipt or an insurance document uploaded to Uber does not establish that CPUC has activated the authority. Check the carrier's actual status and completion requirements before operating. If the permit belongs to a company, establish your relationship to that carrier and which insurance covers the work. Keep the accepted documents and effective dates together so a later renewal, name change or account update does not obscure who was authorized at the time of a trip.

### Have the Authorized Insurer or Broker File the Proof

CPUC requires electronic insurance filings by authorized insurance representatives; buying a policy and filing proof with the Commission are separate steps. Its current passenger-carrier insurance page directs insurers and brokers to TCPortal, used for these filings since June 2021. The electronic-filing guidance explains the insurer or authorized broker role and the types of liability and workers' compensation proof involved. Some older login instructions remain on that guidance page, so use the current portal route identified by the insurance page. Ask your insurance representative to confirm the carrier identity, policy, effective date and successful regulatory filing. Keep that confirmation with your policy documents rather than assuming an ordinary certificate emailed to you also updated the Commission's record.

### Manage Renewal Before a Filing or Policy Lapses

General Order 115-G requires at least thirty days' cancellation notice to the Commission, beginning when the Commission actually receives it. Its section 9 also prohibits operation without the required protection in effect and on file. That regulatory notice period should not be treated as a promise that every private policy benefit remains available after a premium, eligibility or use problem. CPUC's insurance page describes suspension and possible revocation when adequate current insurance is not maintained. If changing insurers, obtain the replacement policy and filing confirmation, check the old cancellation and new effective times, and resolve any gap before operating. Separately monitor the permit's renewal and your platform documents; a valid policy does not renew the operating authority by itself.

### Update the Actual Vehicle and Its Seating Record

General Order 157-E requires a current equipment list with each vehicle's identifying and operational details and additions or deletions within ten days of entering or leaving service. PL-664's equipment instructions count seats including the driver and require an update when capacity changes. Its older liability certification table uses a passenger count excluding the driver, a different denominator from its equipment field. Keep those counts distinct and use the current insurance order and actual endorsement for the limit question. Match VIN, commercial registration, ownership or lease, terminal and driver permissions to the policy and carrier record. Buying a replacement car or borrowing another operator's SUV does not automatically transfer the first vehicle's platform approval, regulatory entry or physical-damage protection.

### Adding a Driver Requires More Than Platform Access

Uber's commercial FAQ requires additional drivers registered to a commercial account to be listed on the commercial insurance policy, and additional vehicles to be commercially licensed and insured for the jurisdiction. General Order 157-E's non-TNC driver provisions also distinguish the permit holder, employees, employees of subcarriers and independent owner-drivers who hold their own authority and operate as subcarriers. Identify the real arrangement before allowing a second person to drive. Ask the insurer to confirm the driver's status, licence, vehicle and permitted operation in writing. A platform login, family relationship or payment arrangement does not by itself establish insured-driver status. Keep the driver's regulatory and inspection records with the fleet's current policy and vehicle schedule.

### Identify Who Supplies the Car and Driver

Under General Order 157-E, a carrier using another carrier that supplies the vehicle and driver must use a subcarrier with charter-party authority and document their names, TCP numbers and services in writing. Uber's California article also lists a TCP subcarrier acknowledgment among its commercial documents. These are operational requirements to inspect alongside the insurance contract, not a blanket promise that one carrier's policy insures every contractor. Ask which carrier is named insured, which drivers and vehicles are covered, whether hired or non-owned arrangements are included and whether contractual liability or additional-insured provisions are required. A driver's work relationship also matters to workers' compensation and optional benefit eligibility; calling someone a contractor in a payment record does not resolve all of those questions.

### Keep Prearrangement Records and Airport Permission

General Order 157-E requires prearranged charter transportation with a waybill identifying the carrier, driver, vehicle, booking and trip details; it permits electronic records subject to production requirements. Its airport rule requires authorization from both CPUC and the airport authority. Do not infer airport permission from a general TCP certificate or from seeing an airport trip in an app. Obtain the applicable current airport operating terms and any required insurance documentation for that operation. This research did not authenticate a current airport-specific commercial liability limit, so none is substituted for the statewide analysis. The dated commercial-supplement article's LAX remarks are not treated as a current statewide eligibility rule. Keep the actual airport approval and route-specific conditions with the carrier's records.

## Economy Trips, Personal Use and Protection for Your Car

### An UberX Request Does Not Restore Ordinary TNC Cover

Uber's commercial FAQ expressly says its ordinary rideshare auto liability policies do not cover trips made as a commercial driver, including economy UberX, XL and Comfort trips as well as Black and Black SUV. Its Black service page allows qualified drivers to choose economy requests, but that product selection does not change the insurance statement. If you alternate products, tell the commercial insurer and retain the trip records and account status. Moving back to an ordinary TNC account requires Uber's support process and consideration of any local registration changes; simply switching a request filter is insufficient. When checking multiple apps or products, do not add ordinary passenger-TNC limits to the commercial result as though both policies necessarily cover the same trip.

Fleet, employee, rental and other arrangements need the specifically identified documents; no individual policy, permit, benefit eligibility or claim outcome is established. Checked 2026-10-27.

### Ask About Other Work and Family Use Explicitly

Uber's commercial FAQ leaves personal use, other business activity and family-driver questions to the actual policy. Ask whether the car is insured when offline, traveling to its normal operating area, taking a private prearranged booking, using another passenger app or making deliveries. Also identify anyone who uses it outside work. A policy written for one livery operation should not be assumed to insure every courier activity or household driver. Conversely, the fact that your car has commercial registration does not itself explain every off-duty exclusion. Request the use wording, driver schedule and endorsements that answer those questions. If changing from an ordinary personal arrangement, coordinate the replacement cover and registration rather than canceling the earlier policy before the new arrangement is effective.

### Choose Physical Damage in Your Commercial Policy

Third-party liability protection addresses specified harm to other people or property; it does not establish cover to repair your own luxury car. PL-912 excludes specified property owned by or rented to the insured, and Uber directs commercial drivers to their own policies. Ask which collision, comprehensive, theft, glass, rental reimbursement, towing and loan or lease-gap protections you purchased for the actual commercial use. Confirm the deductible, insured value or valuation basis, repair conditions and any replacement-vehicle permission. Do not import ordinary Uber passenger contingent repair terms or a $2,500 deductible into a Black policy. A financed or leased vehicle can also have requirements in its financing agreement, so compare those with the coverage actually issued rather than assuming the lender's interest protects your lost income.

### Check Uninsured and Medical Protection Separately

Insurance Code section 11580.2 contains detailed uninsured-motorist provisions, definitions, written coverage choices and conditions. The uninsured protection in your commercial policy must be checked directly; a liability certificate is not proof of its limit, rejection, deductible or application to you and your passengers. Ask about uninsured and underinsured injury cover, any property-damage benefit and medical payments, including the effect of the actual vehicle and employment arrangement. Occupational accident insurance can supply specified medical or wage benefits without reproducing a UM/UIM policy or repairing the car. Preserve copies of coverage selections and any signed rejection with the policy so a later accident can be assessed against the actual terms instead of a general assumption that all compulsory liability insurance includes the same personal benefits.

### A Fleet Employee and a Direct App Driver Are Different

CPUC requires a carrier with employees to maintain and file workers' compensation protection. General Order 157-E identifies different permissible driver relationships for a non-TNC carrier. Proposition 22's app-based-driver definition includes a qualifying TCP driver or permit holder, but it incorporates the independence conditions in section 7451. Those conditions address the network company's relationship with that driver; they do not establish that every person working for a fleet is outside employment law or entitled to every individual network benefit. Establish who engages you, who supplies the car and authority, and which insurer covers injury in that arrangement. Obtain appropriate guidance if the classification is disputed. The public checker does not determine employment status from selecting Uber Black.

## California Occupational Injury Protection

### Check the California Class and Contracting Relationship

Uber's injury page identifies California's automatically provided occupational program separately from its national optional injury product. The live-linked January 2024 Explanation of Coverage includes a TCP driver or permit holder within its transportation-provider definition when the specified contract and class requirements are met. It describes online availability in California and engaged services originating in California. That supports considering the California program for an eligible direct TCP driver; it does not establish every fleet employee's insured status. Obtain the current policy and confirm the policyholder or covered affiliate, driver class and effective coverage. The fourteen-page explanation names Homeland Insurance Company of New York and is expressly an explanation rather than the actual policy or certificate. Do not assign the national optional program's insurer or terms to California by analogy.

### Medical and Wage Benefits Have Their Own Conditions

Business and Professions Code section 7455 requires occupational medical protection up to at least $1 million and specified lost-income benefits for qualifying app-based drivers, along with dependent death protection. The California explanation supplies additional definitions, treatment conditions, exclusions, benefit limits and timing provisions. Read those together: the statutory minimum is not a promise that every treatment, expense or day off work will be paid. Establish that the accident, person, activity and location satisfy the actual policy. Keep the medical records and the carrier's claim instructions in the appropriate private channel. Liability insurance, a workers' compensation arrangement and occupational accident benefits have different insured persons and payment rules; one document's headline amount should not be used as the whole injury answer.

### Use All-Network Earnings and Injury-Year Rates

Section 7455 specifies disability payments at 66 percent of average weekly earnings from all network companies, using total earnings during the twenty-eight days before the accident divided by four, and ties minimum and maximum rates to Labor Code section 4453(a). The statutory reference covers up to the first 104 weeks following injury, with the applicable benefit conditions. DWC's published 2026 temporary-total-disability reference is $264.61 minimum and $1,764.11 maximum per week. The January 2024 explanation's footnote contains older figures and points to rates applicable when injured; it should not freeze a 2026 calculation at 2024 amounts. Preserve all-network earnings evidence and request the actual injury-date calculation, qualifying period and reasons for any adjustment.

### Survivor Benefits Depend on the Actual Family Circumstances

Section 7455(b) refers dependent death and burial benefits to Labor Code sections 4701 and 4702. Those provisions distinguish burial expenses and benefit structures using the injury date and dependency circumstances. The occupational explanation adds its own definitions and claims requirements. Do not describe the program as an unconditional life-insurance payment to any nominated person or promise one fixed total to every family. A dependent claim requires the appropriate relationship, accident and coverage evidence, as well as the applicable statutory calculation. Keep the carrier's decision and supporting calculation, and obtain help with a disputed dependency or timing issue. A general platform accident report does not establish entitlement or complete the beneficiary's separate claim.

### Keep Other-App and Personal Activity in the Timeline

California's occupational statute distinguishes online time from engaged time and permits specified exclusions when a driver is merely online but actively working on another network or pursuing personal activities. It also addresses contribution where more than one network's protection covers an accident and coordination with certain auto insurance benefits. The explanation contains additional benefit-offset and workers' compensation coordination provisions. Preserve which requests were accepted, canceled or completed, any personal detour and the actual work relationship. Do not assume that having several apps open creates several full benefit payments or that an app label defeats every other policy. Notify the relevant insurers and ask them to identify the coordination provisions and calculations used in the particular decision.

## Optional Vehicle Interruption Coverage

### The For-Hire Definition Does Not Include Every Fleet Driver

The actual Illinois Union vehicle-interruption policy, effective April 13, 2026 until canceled, defines a for-hire driver using a Black, limousine, livery or other qualifying vehicle under the specified direct Uber USA contract; taxicabs are excluded from that definition. Its broader transportation-provider definition also excludes a person driving as an employee or independent contractor of an entity contracted with Uber. This matters for fleet and intermediary arrangements even if the person can access the app. The covered auto must satisfy the ownership, lease or rental and insured-person conditions. Ask whether your actual contracting relationship and car qualify before treating the optional benefit as available. The public policy is retained, including its California surplus-lines notice; it does not establish that you enrolled or became an insured.

### A Cash Interruption Benefit Does Not Insure the Car

The policy states a $2,500 benefit per approved claim and a maximum of two claims in twelve months. It expressly excludes auto liability, damage to the vehicle or other property, and injury to a driver, passenger or anyone else. It therefore does not satisfy the TCP liability requirement, replace commercial collision cover or function as workers' compensation. Coverage requires qualifying and opting in, payment of premium, the applicable effective date and completion of the required first trip. Uber's summary describes a per-mile charge; the actual policy and current enrollment offer govern the charge and changes. Its initial declaration premium is not a retail quote for your driving. Compare the benefit, exclusions and premium with the interruption protection in your existing commercial arrangements.

### Keep the Accident, Repair Evidence and Claim Dates

VIC's insuring agreement requires qualifying accident damage preventing operation for at least twenty-four consecutive hours during its covered activity period; its repair-evidence language uses more-than-twenty-four-hour wording, so obtain the insurer's determination for a boundary case. Merely waiting for a request is not the accepted-trip period described in the policy. Exclusions include specified weather events, fire, windshield-only or cosmetic-only damage and certain legal-only inability to use the car. Theft requires a police report. The policy has a thirty-day claim-notice requirement and repair or other supporting evidence duties, with payment described within ten days after approval. A second paid claim terminates cover and introduces a 180-day resubscription restriction. Read the actual conditions rather than assuming any missed shift triggers payment.

## Healthcare Stipend: Relationship, Hours and Proof

### Check Whether You Qualify as an App-Based TCP Driver

The California definition of an app-based driver can include a TCP driver or permit holder who provides passenger services through a network platform and meets the statutory independence conditions. Section 7454 supplies health-subsidy duties for qualifying app-based drivers. Do not infer that every employee or subcontractor working through a fleet receives an individual subsidy merely because trips are dispatched by Uber. Establish the contracting relationship, account and eligibility process, and ask which engaged hours Uber attributes to you. Keep that answer with the applicable terms. Uber's general California help page explains the company's program, but it is not a ruling on an individual's employment status, entitlement under another entity's arrangement or qualification for a particular quarter.

### Use Engaged Hours for the Actual Quarter

Section 7454 uses average engaged hours per week on the particular network during a calendar quarter: at least fifteen but fewer than twenty-five hours supports the partial tier, while twenty-five or more supports the full tier, subject to qualifying enrollment. Engaged time starts at acceptance and ends at completion with the statutory cancellation and other qualifications. Online waiting is not automatically included. Keep the quarterly statements and request correction of a missing trip or attributed period before relying on an estimated tier. The statutory right can permit qualifying subsidies from more than one network, but another app's hours do not simply move into Uber's calculation. Commercial supplement earnings and occupational wage-benefit calculations answer different questions from this engaged-hours test.

### Check the Subscriber Plan and Calendar-Year Amount

The statute defines a qualifying health plan by the driver's subscriber status and excludes employer-sponsored plans and Medicare or Medicaid plans. Uber's current help page separately describes its accepted evidence and particular Medicare-supplement guidance; treat that as company guidance rather than an individual statutory eligibility ruling. Covered California's June 2026 guide provides the annual premium reference and explains the qualifying individual-plan framework. Uber lists 2026 quarterly tiers of $868.38 and $1,736.76; those figures should not be carried into another year's quarter without checking its reference. A health card alone may not establish the subscriber, qualifying plan or relevant enrollment dates. Ask for the actual eligibility reason if the company rejects a plan or determines a different amount.

### Retain Proof, Submission Receipts and Payment Dates

Uber's proof guidance identifies subscriber and insurer information and enrollment dates, with its current instructions allowing the specified document combination and a start before or during the relevant quarter. Its stipend page lists April, July, October and January 15 submission deadlines for the preceding quarters. Section 7454 gives at least fifteen calendar days after quarter-end for enrollment proof and requires a subsidy due within fifteen days of quarter-end or submission of proof, whichever is later. Keep the actual submission receipt and decision date rather than assuming an app review restarts that statutory period. Covered California's current proof guide explains obtaining the coverage PDF; do not assume optional sharing arrangements for another app complete Uber's document process.

## After an Accident and When a Decision Is Disputed

### Report to the Actual Insurers and Preserve the Commercial Trip

CDI's accident guide emphasizes scene information, prompt insurer contact, cooperation and repair records. For a commercial Black trip, identify your actual auto insurer and carrier rather than relying on ordinary TNC claim instructions. Preserve the account's commercial status, accepted product, waybill, booking and pickup records, driver, vehicle and any other-app or personal-use timeline. General Order 157-E also requires specified carrier records and minimum three-year retention. An app report and a report to the liability insurer do not automatically notify an occupational, workers' compensation or optional interruption insurer. Ask each relevant carrier what notice and evidence it requires and keep claim references. Preserve damaged-property and expense evidence before an avoidable documentation gap makes the disputed part harder to assess.

### The DMV SR1 Is a Separate Report

Vehicle Code section 16000 and the current SR1 instructions require a separate DMV report for specified California accidents involving injury, death or property damage over $1,000, subject to the applicable statutory qualifications. The usual filing period is ten days. A police report, app notice or insurer claim does not substitute for the SR1. Use the current official form and the facts of the accident rather than assuming commercial insurance or a carrier's involvement removes the obligation. Keep proof of the filing separately from insurance correspondence, and identify who is responsible where an authorized representative submits it. This research supplies a document checklist; it does not fill a driver report, transmit identifying information or determine a person's reporting exception.

### An Ordinary Claim Notice May Not Preserve Every UM Right

Insurance Code section 11580.2 contains particular requirements and time limits for uninsured and underinsured motorist protection, including specified routes involving an action, agreement or arbitration steps. Different provisions address unidentified vehicles and other circumstances. Do not assume that notifying Uber, filing an SR1 or receiving a routine insurer acknowledgment preserves every legal right. Obtain prompt advice on the actual policy and statutory procedure if an uninsured-driver injury claim is possible, especially while another insurer is still investigating. Keep the relevant notices, signed coverage selections and correspondence. The commercial vehicle's liability filing does not establish the driver's UM/UIM entitlement, and a regulator complaint is not a substitute for every preservation step.

### Ask for the Policy Clause, Facts and Missing Information

California regulation section 2695.5 addresses communications, acknowledgment and investigation duties, including specified fifteen-calendar-day provisions with conditions. Section 2695.7 addresses acceptance or denial after proof of claim, continuing notices and the factual and policy explanation for a denial. Its frequently cited forty-day framework has exceptions, including specified disability and auto repair-bill claims; do not promise the same decision date for every product discussed here. Record when notice, proof and further requests were sent. For a disputed commercial-use, driver or vehicle exclusion, request the actual issued wording and explanation of how it applies to the accident. Distinguish the auto insurer's decision from platform support correspondence and the carrier's operating-authority status.

### Review the Actual Commercial Repair or Total-Loss Calculation

Section 2695.8 supplies automobile-claim standards covering repair estimates, shop choice, comparable-vehicle total-loss value, adjustments and specified taxes, fees, towing or storage. Compare the insurer's calculation with the actual Black vehicle's model, options, condition and mileage and request the supporting comparables. A conditional reopening procedure uses notice within thirty-five calendar days after payment or a final offer where a comparable car cannot be bought for the gross amount, with detailed exceptions. Section 2695.7 also addresses specified deductible recovery through subrogation. Keep estimates, supplements, listings and receipts to identify the disputed amount. These standards do not create physical-damage cover for a car or use excluded by the contract; first establish which actual policy responds.

### Use the Claim Standards for the Injury Product

Occupational injury benefits have different claim questions from an automobile repair bill. Section 2695.11 provides additional standards for applicable life and disability claims, including explanations of benefits, specified overpayment protections and preauthorization rules; it prohibits requiring preauthorization for emergency medical services. Ask the injury insurer to identify the applicable policy provision, covered period, earnings calculation and any medical limit or benefit offset. The California explanation also has workers' compensation coordination terms, so a fleet employee's claim must be assessed under the actual arrangement. Do not apply a simple auto-property timetable to every disability or treatment dispute. Keep benefit decisions, medical and earnings proof, and requests for missing information in the correct private claim channel.

CDI's nonhealth Request for Assistance asks for the insurer, policy and claim details, the problem, requested outcome and supporting records. Supply the denial and specific disputed provision or calculation; its instructions explain that active litigation can lead CDI to defer regulatory investigation. A complaint does not guarantee payment or preserve every separate deadline. General Order 157-E requires a carrier to answer a written transportation-service complaint within fifteen days and retain relevant records, a different duty from an insurance claim decision. Health-stipend eligibility or proof disputes use the network company's process, while Covered California addresses its enrollment matters. Identify the correct insurer, operating carrier or company before escalating so a missing permit, unpaid benefit and repair valuation are not treated as the same issue.

Evidence: Verified. Scope: California Uber Black commercial passenger operation with an owned car, SUV or van. Fleet, employee, rental and other arrangements need the specifically identified documents; no individual policy, permit, benefit eligibility or claim outcome is established. Checked 2026-10-27.
