# Do I Need Insurance for Lyft in Ontario?

Yes. Keep your own automobile insurance and disclose ridesharing. Lyft publishes Ontario waiting and accepted-trip insurance, but the current help page and older linked policy give different repair deductibles. Confirm your vehicle, driver, current endorsements and benefit selections before relying on a snapshot.

Research checked: 2026-10-27. Amounts are USD in the U.S. and CAD in Canada.

## Your Own Insurance and the Actual Lyft Documents

### Keep Personal Insurance and Disclose the Passenger Work

Lyft’s Ontario driver requirements include personal vehicle insurance among the documents an applicant must maintain. Its insurance page says personal insurance applies when driver mode is off and specifically tells Toronto and Windsor drivers to communicate TNC use to their insurer. Ontario’s compulsory-insurance law separately prohibits an owner or lessee from operating, or permitting operation of, an uninsured motor vehicle on a highway. Describe all passenger work, deliveries, other apps, drivers and vehicles accurately to your insurer. Ask which personal coverage and endorsements remain appropriate. A document accepted by the app does not prove that your separate insurer accepted the activity, or that every fleet-policy eligibility condition has been met.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. Checked 2026-10-27.

### The Ordinary Legal Minimum Is Not the Entire Rideshare Answer

Insurance Act section 251 sets the ordinary automobile liability minimum at $200,000 per accident, apart from interest and costs. FSRA treats liability, statutory accident benefits, uninsured automobile and qualified direct-compensation property damage as separate protections. Those ordinary rules do not describe all the insurance needed for paid passenger trips, a particular municipality or your assets. Ontario’s registration guidance also requires valid insurance and vehicle documentation. Check permitted use, insured people, the actual car, injury selections and repair protection together. A larger personal liability number does not, by itself, remove a paying-passenger exclusion or establish the limits of the fleet insurance available while the Lyft app is being used.

The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### The Posted Renewal Certificate Runs to December 2026

Lyft’s current Canadian document directory links an Ontario renewal certificate for policy 41248843, with an Aviva logo and a December 1, 2025 to December 1, 2026 period at the stated local times. It lists $1 million pre-acceptance and $2 million post-acceptance liability, Ontario-origin transportation services, and references to Schedule 1 and APCF 21N. FSRA’s approved-product list identifies Aviva’s Lyft program; that regulatory listing is distinct from the actual renewal certificate and individual enrollment. Neither document identifies every driver or vehicle or rules out later changes. Obtain the certificate and endorsements applicable to your car and accident date. A number shared with an older packet does not prove that every older provision stayed unchanged at renewal.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### The Linked Full Policy Has Older Dates Than the Certificate

The same official directory links an 84-page Ontario policy packet with a 2024 filename. Its ridesharing endorsements are effective December 1, 2024, several pages were issued November 15, 2024, and its base OAP 1 is the form approved from June 2016. These are the documents actually available, not a complete authenticated set of 2026 amendments. The current certificate refers to the endorsements but does not reproduce them. Read the packet to understand the published definitions and conditions, while requesting the operative current set for an individual decision. This guide labels the date difference and retains the unresolved points rather than presenting the entire older packet as newly issued wording.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### The Public Repair Deductibles Conflict

Lyft’s live Ontario help page describes contingent comprehensive and collision with a $2,500 deductible. The linked policy packet’s APCF 21N tables instead show $1,000 for those coverages, with 2024 dates. The current renewal certificate refers to APCF 21N rather than supplying a replacement deductible amount. Neither selecting the cheaper figure nor assuming the web summary overrides the contract establishes your actual current deductible. Ask the insurer for the applicable endorsement and a written explanation of the discrepancy. Both the article and checker preserve this uncertainty; the coverage snapshot remains qualified instead of presenting one figure as a verified instruction for a particular driver or claim.

Evidence: Conflicting sources. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### Keep Current Law Separate From the Older Printed Form

FSRA posts a July 2026 standard OAP 1, while the Lyft packet contains a June 2016 base form and older attached endorsements. A later public form does not automatically replace every sentence of an issued contract, and the older packet does not remove applicable statutory protections or transition rules. Read the actual certificate, policy, endorsements and relevant law together. Promptly report material changes in use, drivers, ownership or other relevant risk information under the applicable policy duties. Updating an insurance-card image in Lyft is a different step from notifying your personal insurer or obtaining an amended contract. Keep the insurer’s response and the actual documents applicable to the change.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ## Passenger Requests, Pickup, Drop-off and Other Work

### Waiting Means Logged On and Available for Requests

The published APCF 6T and APCF 21N definitions require both logging into Lyft’s network and being available to receive requests before acceptance or logout. The current certificate and summary list $1 million liability for pre-acceptance. Treat availability, the particular vehicle and the actual driver as facts to establish, rather than assuming that an installed app or an old screenshot proves the period. The older endorsement also describes primary protection only within its defined periods and subject to its limitations. Preserve reliable app-status records where a loss occurs while waiting. The quoted liability amount is not a million-dollar repair allowance or a promise of every injury benefit to every person nearby.

### Accepted-trip Protection Includes Travel to the Passenger

The posted certificate and Ontario summary list $2 million post-acceptance liability. The linked wording starts the period when a request is accepted through Lyft’s network, including travel to pickup, collection, carriage and drop-off. You should therefore examine the accepted-request period for a crash on the way to a passenger, rather than waiting until the passenger is seated. The renewal certificate specifies Ontario-origin transportation services. An Ontario destination or an Ontario licence plate alone does not establish that origin condition. Retain request and pickup details and check the policy applicable to a trip starting elsewhere; this guide does not establish equivalent coverage for every cross-border journey.

### Cancellation and Passenger Exit Are Distinct Events

The dated endorsement ends its post-acceptance period using the last passenger’s departure, a trip ending or a trip being cancelled, with a whichever-is-later provision. Do not reduce that wording to a universal rule that tapping cancel immediately ends all protection, or that a trip left open on a phone supplies unlimited coverage for unrelated later travel. Establish when the actual passenger left and which trip events occurred. These are passenger definitions: the packet does not provide the goods-return language found in another company’s delivery policy. A useful incident chronology identifies the accepted Lyft request, pickup, any cancellation, passenger exit and later activity without importing another app’s wording.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### A Municipal Insurance Requirement Is Not a Province-wide Permit

APCF 6T contemplates higher post-acceptance limits where an Ontario municipality requires them, supplied through a separate municipal certificate. Its passenger-trip wording uses the origin municipality’s post-acceptance limit where pickup and drop-off are in different municipalities. That is a particular insurance provision, not proof of permission to accept every pickup or use every airport. Ask for an applicable separate certificate and the local operating requirements before assuming a general fleet certificate settles both questions. Toronto’s posted code has its own PTC insurance provisions. This guide does not verify every municipal amendment, airport permission or a driver’s actual compliance with those requirements.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### Another App or Private Booking Cannot Inherit This Policy

The posted definitions tie ridesharing to Lyft’s digital network and exclude taxicab and licensed limousine or livery services from that definition. They do not convert an offline private booking, another platform’s accepted trip or a food-delivery assignment into a covered Lyft passenger request. Disclose all activities to your insurer and preserve which request you accepted if multiple apps were open. Licensing, vehicle and injury-benefit questions can differ between the activities even when you use one car. The checker keeps each platform’s published research separate and withholds the ordinary owned-car snapshot for commercial or unsupported arrangements. An app’s ability to remain open does not resolve competing policies or their priority.

## Vehicle Eligibility and Local Passenger Permissions

### The Actual Automobile Must Qualify Under the Schedule

Schedule 1 defines the relevant Lyft driver, owner and described automobiles in the pre-acceptance and post-acceptance periods. APCF 21N addresses Ontario-licensed or required-to-be-licensed vehicles and the automobile schedule filed with the insurer. It expressly withholds its coverage for an existing owned or leased vehicle omitted from that schedule until a coverage request has been filed. Do not assume that a second household car, replacement vehicle or different owner is included merely because the same driver can log in. Confirm the actual vehicle and driver with the platform and insurer. Fleet monthly premium reporting is not proof that every individual driver must personally submit the fleet’s monthly return.

The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### A Rental Clause Does Not Establish App Permission or Full Repairs

Lyft’s Ontario requirements say the vehicle must not be a rental, taxi or stretch limousine. The older insurance endorsement nevertheless contains provisions for particular owned vehicles, leases over 30 days and limited coverage for rentals of no more than 30 days. Those insurance clauses do not override the platform’s eligibility rules or establish all collision and comprehensive benefits for a rented car. Some public form fields are blank; this guide does not fill them with another company’s reporting interval. Borrowing also raises ownership, driver and underlying-coverage questions. Confirm the actual arrangement separately; the checker’s owned-car snapshot is not applied to borrowed or rented selections as though they were identical.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### Insurance, Inspection and Registration Are Different Documents

Lyft’s Ontario instructions require personal insurance, vehicle registration and a Safety Standards Certificate, with additional driver and local documents. They describe inspection submission within 36 days and different inspection frequencies for specified cities and vehicle ages. An SSC assesses vehicle safety; it is not an insurance policy or permission from your insurer for paid passenger use. Conversely, an active policy does not prove the car satisfies inspection, age, registration or local licensing requirements. Keep the correct vehicle information across the documents and obtain the current city-specific instructions before relying on an application approval. Do not treat one province-wide vehicle checklist as proof that every city and every premium service has identical eligibility.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### Toronto Requires Its Own PTC Driver Process

Toronto’s current driver guidance says applications go through the PTC, requires approved training for new applicants, and says a separate licence is needed for each PTC a person drives for. Lyft likewise says it applies for the Toronto licence on the qualifying driver’s behalf and instructs the driver to keep it in the vehicle. A taxi or limousine driver licence does not automatically replace the PTC requirement. Keep this local approval separate from your personal policy and fleet certificate. The municipal webpage has current instructions, while the posted code consolidation reviewed here is dated June 27, 2024; it is not a claim that every subsequent municipal change or individual application has been authenticated.

Evidence: Verified. Scope: Ontario ordinary owned-car Lyft passenger trips. ### Toronto’s Company CGL Is Different From the Driver’s Auto Cover

Toronto’s posted code section 546-114 requires at least $2 million automobile protection for the specified PTC vehicle and trip circumstances, addresses certificates and notice requirements, and separately requires the PTC to have at least $5 million commercial general liability insurance. The City’s company application page requests a CGL certificate for that business requirement. Do not turn the company’s CGL limit into an instruction that every ordinary Lyft driver must buy a separate $5 million personal policy. Nor does the corporate certificate establish every driver’s car-repair benefit. Ask which obligation belongs to the PTC, the individual driver or the automobile, and which actual policy or licence supplies the required evidence.

The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### Local Documents Do Not Transfer in Exactly the Same Way

Lyft’s Ontario page distinguishes local document requirements. For Niagara it describes a TNC driver licence that need not be Lyft-affiliated, but a TNC vehicle licence that must be affiliated with Lyft. For Toronto it describes the separate PTC application process; it also lists different identification or business documents for other cities and tells drivers to follow airport rules. These are the platform’s published instructions, not an independent verification of every local permit or current municipal bylaw. Check the actual operating city when adding an app or changing locations. A document sufficient for one city or one vehicle should not be presumed sufficient for a different pickup location or platform.

## Repairs, Deductibles, Valuation and Replacement Transport

### The Repair Condition Requires Both Underlying Coverages

The renewal certificate conditions collision and comprehensive on the rideshare driver carrying both under the underlying personal owner’s policy for the vehicle. The older APCF 6T and APCF 21N instead refer to the vehicle owner and allow the stated OAP 1 or OAP 4 underlying forms. They define in force with an express qualification concerning the paying-passenger exclusion. Preserve those distinctions, especially where driver and owner differ; do not silently replace this language with another platform’s condition. Liability-only insurance, or comprehensive without collision, cannot simply be treated as meeting both requirements. Obtain the current endorsement and underlying-policy answer before assuming a disputed deductible is the only issue affecting repairs.

### DCPD and Collision Are Separate Ways to Examine Damage

Lyft’s summary describes direct-compensation property damage separately from contingent collision and comprehensive. Insurance Act section 263 and OAP 1 section 6 impose conditions, including an Ontario accident and another involved automobile with qualifying insurance. The amount depends on the share for which the driver is not at fault; the Fault Determination Rules govern the applicable allocation. Do not use a universal half-payment shortcut for every partly at-fault accident. The public Lyft materials do not establish that its DCPD deductible is the same as the disputed collision figure, or the $0 figure stated in a different company’s policy. Ask which coverage, deductible and fault allocation the insurer is applying to the actual loss.

### Check Any Written DCPD Election and Its Effect on Collision

Ontario’s OPCF 49 permits the stated written election not to recover DCPD damages and warns about losses to the car, contents and loss of use even where another driver is responsible. The framework also affects availability of collision protection under the policy concerned. Regulation 664 section 5.2 addresses written election and revocation. A publicly posted form is not evidence that you or the fleet actually signed it. If an election affected your personal policy, ask how the fleet’s underlying-collision condition is satisfied and which current endorsements apply. Do not assume one policy’s election automatically proves every result under another contract, or that finance obligations disappear when protection is removed.

### A Hit-and-run Repair Is Not Necessarily an Uninsured-injury Claim

The linked OAP 1 section 5 distinguishes injury protection from a property claim against an identified uninsured owner or driver. Its property route has a $25,000 limit and $300 deductible, while damage caused by an unidentified automobile is excluded under that section; another purchased coverage may be relevant. The Ontario help page’s broad uninsured and underinsured descriptions and large period limits should not be copied as a promise to repair every car hit by an unknown driver. Identify whether the issue is injury, identified-uninsured property damage, DCPD or collision. Preserve available evidence and obtain the insurer’s explanation under the actual current policy rather than choosing a benefit solely by its familiar label.

### The Car’s Insured Value and the Loan Balance Are Different

Lyft’s summary describes vehicle repair protection up to actual cash value or repair cost, whichever is less, subject to the applicable terms. The posted OAP 1 also addresses depreciation, repair, replacement and salvage. A financed car’s remaining debt can differ from that value. Lienholder and lessor schedules identify particular interests; they do not promise a new car, the original purchase price or automatic payment of the outstanding loan. Keep mileage, condition, equipment and valuation evidence so a disagreement can be assessed. Ask whether any separate gap or replacement-cost protection was actually purchased and applies to the work, instead of adding it to a fleet snapshot because a lender is listed.

### Replacement Transport and Time Without Earnings Need Their Own Terms

The older OAP 1 includes a limited whole-car theft transportation provision with a 72-hour trigger after the specified report and a $900 maximum, subject to its conditions. It does not create universal rental reimbursement after every collision. FSRA’s optional-coverage guidance and OPCF 20 explain separately purchased replacement transportation, but a public form is not proof it was attached. Payment for a rental and permission to use that rental for Lyft are also separate questions, particularly given Ontario’s published vehicle restrictions. None of these provisions establishes a general promise to replace every day of lost fares while a car is repaired. Ask about the exact cause, cost, activity and benefit actually insured.

The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### Passenger Property and Business Equipment Are Not All Automobile Repairs

The linked liability wording excludes property carried in the automobile and other property in an insured person’s care, custody or control, and has a contamination exclusion for carried property. The vehicle-damage section also limits cover for non-equipment contents and ordinary wear. A passenger’s damaged bag, a stolen phone, a mechanical breakdown and collision damage to the car therefore require different questions. Do not present a liability limit, an app reimbursement process or contingent collision as automatic cover for each loss. Identify the alleged liability, property owner, damaged item and actual policy wording, and ask whether any separate business or personal protection is needed for an exposure left outside the automobile contract.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ## Injury Benefits and the July 2026 Transition

### A December Renewal Changes How to Read the July Reform

SABS section 2 distinguishes contracts entered into or renewed from July 1, 2026, the continuation of prior benefits at renewal, written changes to earlier contracts, and the persons eligible for the newly optional categories from July 1. Lyft’s public renewal certificate starts in December 2025 and ends in December 2026. You cannot therefore infer from the July date alone that every benefit was removed halfway through that term. Equally, the certificate does not prove that no written change occurred. FSRA’s reform materials explain the purchasing changes. Ask for the actual benefit selections, any mid-term amendment, the insured person’s status and the accident date before applying a general reform headline to this fleet.

Evidence: Company-reported. Scope: Ontario ordinary owned-car Lyft passenger trips. The current public renewal certificate, dated linked policy and current law are distinguished; individual enrollment, current endorsements, repair deductible, benefit elections, local permits and claim entitlement are not authenticated. ### Older Optional Enhancements Are Not the Entire New Optional Framework

The 2024 APCF 21N table shows standard accident benefits included and optional increased accident benefits not covered. The renewal certificate likewise refers to standard benefits and says purchased increases would be listed. That older distinction between standard benefits and enhancements is not interchangeable with the July 2026 framework making specified benefit categories optional. Do not read an old not-covered enhancements box as proof that every current income, death or other benefit is absent, or as proof that every listed benefit is payable to every claimant. Compare the current schedule, amendments and SABS transition provisions. The posted packet supplies useful background, while the driver’s actual current benefit selection remains a question to resolve.

Reg. 34/10: STATUTORY ACCIDENT BENEFITS SCHEDULE - EFFECTIVE SEPTEMBER 1, 2010](https://www.ontario.ca/laws/regulation/100034)

### Covered-person Status Matters After July 1

SABS section 2(1.0.4) limits the specified optional categories to named insureds, their spouses and dependants, and persons specified as drivers. FSRA’s October 2026 fleet guidance also discusses deemed named insureds under the statutory tests and cautions that the actual circumstances matter. The older Lyft Schedule 1 names qualifying rideshare drivers and vehicle owners within its defined scope, but an account display name does not establish every statutory fact. Ask the insurer to explain the relevant insured-person status for the benefit sought. An injured driver, passenger and family member need not have identical rights under each policy or benefit merely because the same collision appears in the same app report.

### A Benefit Ceiling Does Not Establish the Actual Payment

Current SABS rules distinguish the minor-injury framework, other non-catastrophic impairment and catastrophic impairment, with their applicable expense limits, exceptions and HST provisions. Income-replacement provisions separately examine work or self-employment, disability, earnings calculations, offsets and purchased ceilings; the test changes after 104 weeks. Preserve medical and reliable income evidence rather than treating app receipts or a policy headline as the statutory calculation. Neither a vehicle-repair payment nor a passenger fare establishes the severity classification or weekly injury entitlement. Ask which benefits and selections actually apply under the relevant contract and law, particularly where the public packet predates the reform and a current optional-benefit schedule has not been authenticated.

### Do Not Assume a New Standard Endorsement Was Added Automatically

The dated APCF 6T has its own accident-benefit priority language for a rideshare driver, subject to its defined periods and exclusions. Current FSRA guidance and the separately posted OPCF 47R address optional benefits, eligible people, selections and priority under that endorsement. Its availability in a regulator’s library does not prove it was attached to this older public Lyft packet or elected for your circumstances. Insurance Act section 268 and applicable SABS provisions must be read with the actual current contract. Ask which policy receives the application and why, and how any priority waiver or benefit election operates. Do not assume that several policies simply add their weekly limits together.

### Family Protection Is Different From a General Two-million-dollar Benefit

The certificate and dated APCF 6T list OPCF 44R family protection with limits corresponding to the pre-acceptance and post-acceptance liability limits. The attached form concerns qualifying injury or death involving an inadequately insured motorist, with eligibility definitions, deductions, evidence, multiple-coverage rules and a Quebec exception. It is not another collision allowance or an automatic cheque equal to the printed limit. FSRA separately posts a newer approved OPCF 44R form; that does not establish that every definition in the older attached version has been replaced. Preserve the actual form applicable to the accident and obtain advice about any material difference rather than assuming all versions or family relationships are treated identically.

### A Fleet Policy Does Not Decide WSIB Status

WSIB’s independent-operator guidance specifically discusses transportation and rideshare relationships, using the applicable status process and actual business circumstances. Its guidance distinguishes using the same vehicle identification number under an existing status ruling from changing vehicles and needing a new questionnaire. An app’s contractor label or an automobile certificate does not resolve every statutory status, registration or optional-coverage question. Ask WSIB about the relationship and relevant coverage where needed. Keep workplace insurance separate from car repairs, automobile accident benefits and other injury products. Coordination, eligibility and offsets can matter, so an injured driver should not assume that the existence of one policy establishes a right to collect the same loss under every possible scheme.

## Incident Reporting, Claims and the Right Dispute Process

### Report to Lyft and the Insurer Through the Correct Channels

Lyft’s Ontario page directs accident reports to its Trust and Safety process. The posted OAP 1 separately requires written insurer notice within seven days under the stated provisions, with an incapacity qualification. Reporting through an app does not by itself prove the insurer received all required information or forms. Record the driver, vehicle, request, pickup, cancellation, passenger exit and subsequent activity accurately. Preserve report references and proof of receipt, and forward relevant claim correspondence through the appropriate channel. The initial report is not an invitation to guess fault, promise a settlement or assume the insurer has already accepted coverage. Obtain confirmation of what remains required under the applicable current contract.

### SABS Notice and the Application Use Different Triggers

SABS section 32 generally requires notice of an intention to apply within seven days after the circumstances giving rise to benefit entitlement arise, or as soon as practicable after that. A completed and signed application is generally due within 30 days after receiving the forms. Section 34 addresses a reasonable explanation for a time-limit failure; it is not a reason to postpone reporting. Keep the forms, insurer correspondence and proof of delivery. A repair estimate, an app incident number or a later complaint does not replace the injury application. If timing is disputed, seek advice about the actual provision, explanation and evidence rather than assuming every late claim is automatically lost or automatically excused.

### Protect the Car and Preserve Valuation Evidence

The posted statutory conditions require reasonable protection from further damage, specified automobile-loss proof including a sworn declaration within the stated 90-day condition, and insurer inspection or consent before nonessential repairs or destruction of evidence. Keep estimates, photographs taken safely, condition records and the app chronology. Insurance Act section 128 and the contractual appraisal provisions address defined repair or valuation disagreements after the necessary steps; they do not automatically decide whether the activity or person was insured. A preliminary estimate is not necessarily completed proof of loss. Ask what the insurer still requires and whether appraisal addresses the actual disagreement before treating it as a solution to every coverage issue.

### Unidentified Motorists and Family-protection Claims Need Specific Evidence

The posted OAP 1 section 5 contains particular police-reporting, written-statement and supporting-evidence requirements for unidentified-motorist injury claims, with stated qualifications. The attached OPCF 44R adds notice, cooperation and corroboration provisions, including independent or physical evidence for certain unidentified-vehicle allegations. An app trip record helps establish the work sequence but does not replace all those requirements. Preserve witnesses and available recordings lawfully without publishing private passenger information. Determine whether you are making an injury, family-protection or car-damage claim and ask for the applicable current wording promptly. The label hit-and-run does not establish that all those claims have the same evidence conditions, deductible or limitation period.

### Payment Conditions Are Different From Legal Limitation Periods

The posted OAP 1 conditions address payment of money the insurer is liable to pay after proof of loss, with separate rules for appraisal and a repair or replacement election. They also state different action periods for automobile or contents loss and for persons or other property. OPCF 44R has its own proceeding language. These provisions should be examined with applicable law and any available relief; they are not a promise that every claim settles within a fixed number of days after the collision. Obtain prompt advice about the specific loss and dispute. Continuing negotiations, an app conversation, a complaint or an appraisal do not themselves establish that a tribunal or court deadline has stopped.

## Choose the Process That Matches the Dispute

### Insurer Priority Has Its Own Payment Procedure

Regulation 283/95 requires an insurer notified of an intention to seek benefits to provide appropriate forms. An insurer supplying the application must not obstruct its completion, refuse it or redirect the applicant. The first insurer receiving a completed application must commence benefits in accordance with the SABS while insurer-priority issues are resolved. That procedure does not establish eligibility for every requested benefit or justify duplicate inconsistent claims. Retain receipt records and ask which specific issue is being decided if referred between insurers. An insurer-to-insurer priority disagreement is different from a dispute about the amount of your benefit, vehicle value or the platform’s account decision.

### Keep the Insurer Complaint Separate From Platform Support

FSRA’s complaint instructions direct consumers to the insurance company’s complaint officer and call for a final position letter. Keep the relevant wording, decision, chronology, requested resolution and correspondence. A platform account issue may need another channel. Regulatory review does not guarantee compensation, replace the claim application or preserve every legal deadline. FSRA’s consumer guidance also describes rights and duties during insurance and claims handling. Identify whether the issue is missing evidence, service, valuation, policy interpretation or benefit entitlement, and send sensitive claim or medical material only through the appropriate process. A single general support conversation need not resolve all those different questions.

### LAT-AABS Does Not Determine Every Car-insurance Dispute

Insurance Act section 280 and Tribunals Ontario’s LAT-AABS guidance address statutory accident-benefit entitlement and amounts. LAT-AABS does not decide vehicle damage, fault, pain-and-suffering claims or which insurer has priority. Its guidance generally describes a two-year application period after the insurer’s denial notice and possible extensions. Do not substitute that timeline for different contractual and legal issues affecting property or family-protection proceedings. Obtain timely advice about the actual decision and limitation question, including where time may already have passed. A complaint, an expectation of reconsideration or ongoing correspondence does not prove that the necessary tribunal application or legal proceeding was started in time.
