# Workers’ Compensation Insurance in Washington

Washington requires employers to cover workers unless a specific statutory exclusion applies, and private workers’ compensation policies are not allowed: employers use L&I’s State Fund or qualify as certified self-insured employers. A 1099 or business license does not establish an independent-contractor exclusion, so classify each person under Washington’s tests before reporting hours.[^1][^2][^3]

## What Is Workers’ Compensation?

Workers’ compensation can pay medical care and part of an employee’s lost wages after a work-related injury or illness. ## What to Watch for in Washington

### State Fund or Certified Self-Insurance

Washington does not allow private workers’ compensation coverage. Most businesses obtain a State Fund account through L&I; self-insurance is limited to employers certified by L&I. When comparing proposals, confirm the provider is arranging a compliant Washington route rather than a private policy that cannot satisfy this state’s system.[^1]

### A 1099 Does Not Exclude a Worker

L&I says a 1099 and contractor registration number do not decide workers’ compensation status; the worker must meet Washington’s exemption test. If a contractor fails it, you must report their hours and pay the state premium, so document each test element before excluding labor from your quarterly report.[^3][^2]

### Owner Exclusions Depend on Structure

Sole proprietors and partners are excluded by statute. Corporate officers may qualify under an ordinary exclusion only when they satisfy its director, shareholder, substantial-control and nonmanual-work tests; a nonpublic corporation may instead exempt up to eight qualifying officer-shareholders, or any number of officers related by blood within the third degree or marriage. LLC-member treatment depends on whether management is vested in members or managers. Ask L&I to check each owner under the right entity rule and whether you want elective coverage.[^2][^1]

### Report Hours by Work

L&I bases State Fund premiums on industry and workers’ hours and directs employers to report hours quarterly. Give your broker or L&I the actual work performed and hours by worker so the account uses the right business classification and payroll report.[^1]

## Who Regulates Insurance in Washington

**Washington State Office of the Insurance Commissioner.** The Washington State Office of the Insurance Commissioner administers Washington insurance laws, oversees insurers and insurance producers within its authority, and provides regulatory and consumer resources. You can use the department's complaint process to raise an insurance issue and its licensing resources to check insurance professionals.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2% of premium The NAIC's state chart lists a 2% of premium charge for surplus-lines coverage for Washington (the chart's state entries were reviewed in October 2025). Your broker may collect the applicable amount with the premium. Surplus-lines insurers are not licensed in the state and generally are outside state guaranty-association protection; ask your broker to explain the insurer's financial protections and any diligent-search requirement that applies to your placement.[^7][^8]
