# Workers’ Compensation Insurance in Utah

Utah generally requires every employer to provide workers’ compensation coverage for employees, with a few exceptions. A limited Workers’ Compensation Coverage Waiver may be available for certain owner-only businesses or individuals treated as statutory employees.[^1][^2]

## What to Watch for in Utah

### A Waiver Is Limited to Listed Owner Situations

Utah allows eligible sole proprietors with no employee other than the owner, partnerships with no employees other than partners, some LLC members, and certain corporate officers to seek a waiver or exclusion. A waiver does not establish coverage for the business’s other workers; confirm who remains insured.[^2]

### Corporate Exclusion Has a Five-Officer Cap

A corporation that does not contract its work and has no employees except directors or officers may exclude no more than five of them under the Commission’s waiver guidance. Ask whether the company meets both conditions and who is named in the approved exclusion.[^2]

### Self-Insurance Has Material Financial Thresholds

Utah generally requires at least five years in business, $10 million net worth, acceptable security, and excess workers’ compensation coverage for self-insurance. Ask whether your organization meets current Labor Commission prerequisites before comparing that route with a policy.[^3]

## Who Regulates Insurance in Utah

**Utah Insurance Department.** The Utah Insurance Department regulates licensed insurance companies and producers, offers a public licensee search, and accepts complaints about property/casualty insurance. Complaint jurisdiction depends on policy type and place of issue; employer self-funded plans are outside the Department’s authority.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.25% of gross premium including policy fees, plus 0.18% stamping fee For Utah-home-state surplus-lines coverage, Utah charges 4.25% of gross premiums including policy fees, less returned premiums, and the Surplus Line Association of Utah collects a 0.18% stamping fee.
