# Workers’ Compensation Insurance in Nevada

Nevada requires employers within the Industrial Insurance Act to secure compensation for employee injuries. The statute separately makes coverage compulsory for the state, local governments, and contractors under those entities regardless of employee count; a contractor working on a public project should verify both its own coverage and any consolidated program terms.[^1][^2]

## What to Watch for in Nevada

### One Employee Brings Most Employers Into the Act

NRS 616B.633 applies the industrial-insurance chapters to employers who employ at least one employee. Ask the broker to confirm worker status and Nevada policy coverage as soon as you hire, not after payroll grows.[^1]

### Public Projects Carry No Employee-Count Exception

For the state, local governments, and their contractors, coverage is compulsory without regard to how many people they employ. Before bidding or staffing public work, confirm the policy or consolidated insurance program covers the contract’s employees.[^1]

### Check Whether a Construction Program Covers Your Employees

Nevada law lets contractors and subcontractors satisfy the coverage duty to the extent their employees are covered by a consolidated insurance program. Ask for the project-specific enrollment and covered employee class rather than assuming every subcontractor is automatically included.[^1]

### A Coverage Gap Can Trigger Back Premiums and Criminal Penalties

The Administrator may charge premiums for the uninsured period, capped at six years, plus interest. A first offense is generally a misdemeanor; a first offense involving an employee’s substantial bodily harm or death is a category C felony. ### Surplus-Lines Tax and Stamping Office
