# Workers’ Compensation Insurance in Idaho

Idaho generally requires coverage before an employer hires its first full- or part-time, seasonal, or occasional employee. An out-of-state employer with a worker telecommuting from an Idaho home must have an Idaho-endorsed policy, even for occasional or seasonal work.[^1][^2]

### A Home-Based Idaho Employee Requires an Idaho Endorsement

An out-of-state employer with an employee working from an Idaho home must have a policy endorsed for Idaho, regardless of full-time, part-time, seasonal, or occasional status. Telecommuting does not qualify for the casual-employment or outworker exemptions, so tell the carrier where the worker actually works.[^2]

### The Co-Resident Family Exception Is Narrow

Family members living with an owner are automatically exempt only when the business is a sole proprietorship or a single-member LLC taxed as a sole proprietorship. The separate election for a nonresident family member applies only when the employer is a sole proprietor; confirm the entity type and household relationship before excluding anyone.[^2]

### Idaho Uses a Right-to-Control Test for Contractors

Idaho uses a right-to-control test, but a worker paid under a written or verbal contract may still be an employee. The Industrial Commission says it considers contract-labor situations case by case, so describe the actual work arrangement and ask the Commission or broker how it affects your coverage.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%.
