# Workers’ Compensation Insurance in Alaska

Alaska generally requires an employer with one or more Alaska employees to carry workers’ compensation insurance unless approved as a self-insurer. An out-of-state policy does not automatically satisfy Alaska exposure: the state says it has no reciprocity agreements and requires coverage for employees working there.[^1][^2]

## What Is Workers’ Compensation?

Workers’ compensation can pay medical care and part of an employee’s lost wages after a work-related injury or illness. ## What to Watch for in Alaska

### Line Up Coverage Before the First Alaska Hire

The Alaska Department of Labor says each employer with at least one Alaska employee needs insurance unless approved to self-insure. Owners such as sole proprietors and partners are exempt from insuring themselves, but their businesses still must insure employees, including family and friends.[^1]

### Owner Exemptions Depend on Entity and Ownership

The agency lists sole proprietors and partners, plus LLC members and for-profit corporate officers with at least 10% ownership, as exempt from insuring themselves; nonprofit and public entity officers have a different election rule. Give your broker the entity type and ownership percentages rather than assuming every owner is excluded.[^1]

### An Out-of-State Policy Needs Alaska Treatment

Alaska reports no reciprocity agreements and says out-of-state employers must insure employees working in Alaska whether based there or elsewhere. Ask the carrier to confirm Alaska coverage in writing before sending staff to a temporary project.[^1][^2]

### Assigned Risk Is the Fallback After Carrier Difficulty

Alaska has no state workers’ compensation insurance fund; employers unable to obtain a commercial policy may apply to the NCCI-administered assigned-risk pool. Ask the broker about this route if voluntary carriers will not quote the operation.[^1]

## Who Regulates Insurance in Alaska

**Alaska Division of Insurance.** The Alaska Division of Insurance regulates insurers and insurance licensees, provides company and licensee searches, and investigates insurance complaints within its authority. Its consumer-services section handles disputes involving claims, cancellations, premium refunds, agents, and insurers.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.7% of gross premium less returns plus 1% filing fee; wet marine: 0.75%, no fee For covered property and casualty surplus-lines risks, Alaska lists a 2.7% tax and a separate 1% filing fee on gross premium less returned premium. Qualifying wet-marine and transportation policies instead carry a 0.75% tax on gross premium and no filing fee; risks of state or local government and certain interstate aircraft are exempt from both tax and fee. A multistate placement is regulated under the insured’s home-state rules, and Alaska says to evaluate each policy’s home state separately.[^7][^6][^8][^9]

**Alaska has a placement-list exception:** If a risk appears on Alaska’s surplus-lines placement list, the Division says the broker does not have to canvass admitted insurers for declinations before placement; the broker must document the applicable list entry.[^6]

**Alaska has limited tax and search exceptions:** The Division says qualifying wet-marine and transportation policies need no diligent search and pay no 1% filing fee. Tax and filing fees also do not apply to state or political-subdivision risks or qualifying interstate aircraft, although other placement requirements remain.[^10]
