## What to Watch for in New York

### Remote Practitioners Still Need New York Licenses

Under Public Health Law § 2805-u, an originating hospital may rely on a qualifying distant-site hospital’s credentialing process, but each telemedicine practitioner must be licensed in New York. The distant hospital must review credentials at least every two years and report outcomes and complaints. Ask the broker to schedule the hospital entities, remote clinicians, and credentialing arrangement.[^1]

### Medicaid Requires Same-Rate Payment for Equivalent Care

New York requires telehealth services to receive Medicaid reimbursement on the same basis and at the same rate as equivalent in-person services, subject to the statute and regulations. Do not assume this rule guarantees reimbursement by commercial plans; compare each payer contract and coverage terms.[^2]

### Telehealth Does Not Authorize Unlicensed Services

New York’s telehealth law does not authorize anyone to provide a service requiring an Education Law credential that the person does not hold. Confirm each profession’s credential and tell the broker which services and specialties are delivered across the state.[^3][^2]
