# Telehealth Insurance in Minnesota

Minnesota lets an out-of-state physician treat patients located in the state through annual Board registration, if the physician meets license, discipline, and no-in-state-office conditions. Minnesota also mandates telehealth coverage and same-rate reimbursement for covered services, while audio-only coverage has a temporary statutory definition through July 1, 2027.[^1][^2]

## What Is Virtual Care And Telehealth?

Telehealth liability can cover claims arising from remote health care, such as a video visit or remote monitoring. If you provide care online, match the quote to your clinicians, services and patient locations; cyber and in-person risks need separate review. [Read the national Virtual care and telehealth guide](/coverage/virtual-care-telehealth).

## What to Watch for in Minnesota

### Out-of-State Physicians Must Register Each Year

An unlicensed physician may provide interstate telehealth after confirming an unrestricted out-of-state license, no revoked or restricted license in any jurisdiction, no Minnesota office or in-person meetings, and annual Board registration. Registration also subjects the physician to Minnesota law and courts for state-patient care; ask the broker to schedule these clinicians and patient exposure.[^1]

### Covered Services Receive Same-Rate Payment

Minnesota requires covered health plans to reimburse telehealth at the same basis and rate as the same in-person service, subject to statutory plan and service terms. Confirm your payer contracts, services, and provider network fit the law and accurately describe the business insured.[^2]

### Audio-Only Definition Has a 2027 Sunset

Through July 1, 2027, Minnesota’s definition includes audio-only scheduled visits when the standard of care can be met that way, plus qualifying crisis or emergency mental-health and substance-use communications. Ask whether your policy and billing controls are prepared for this statutory window and any later change.[^2]

## Who Regulates Insurance in Minnesota

**Minnesota Department of Commerce.** The Minnesota Department of Commerce regulates insurance companies and producers, reviews rates and forms, and investigates complaints. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of taxable gross premiums less return premiums, plus a 0.04% stamping fee on taxable premium when Minnesota is the insured's home state When Minnesota is the insured's home state, 3% tax applies to taxable gross premiums less return premiums; the separate 0.04% stamping fee on taxable premium is paid by you to the broker. Minnesota requires a policy warning that insolvency loss payment by a nonadmitted insurer is not guaranteed. A diligent search generally applies unless a Minnesota-licensed producer unaffiliated with the surplus-lines broker refers the risk, which the statute deems unavailable from a licensed insurer; an exempt commercial purchaser also has a separate written-request route after the required admitted-market disclosure.[^6][^9][^7][^8][^10]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://www.commerce.mn.gov/commerce/licensing/license-lookup/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Minnesota

1. Which clinicians need Minnesota interstate telehealth registration and when does each registration renew?
2. Do our audio-only workflows meet the statutory scheduled-visit or crisis conditions through July 1, 2027?
3. Does our policy describe the services and provider networks covered by Minnesota’s parity law?

## Virtual Care And Telehealth in Minnesota: FAQ

### Can an out-of-state physician provide telehealth to Minnesota patients?

Yes, if the physician meets the statute’s license and discipline conditions, does not open an office or meet patients in Minnesota, and registers annually with the Minnesota Board of Medical Practice.[^1]

### Does Minnesota require equal telehealth reimbursement?

Yes. For covered services, Minnesota requires a health carrier to reimburse telehealth on the same basis and at the same rate as the same service provided in person.[^2]
