### Consent and Identity Checks Need Documentation

Health Occupations § 1-1002 requires identity verification, disclosure of the practitioner’s name, contact information, and license type, and oral or written patient consent. Ask the broker to include your actual telehealth modalities and clinician roles, and confirm your recordkeeping matches the consent workflow.[^1][^3]

### A Questionnaire Alone Does Not Support Treatment

Before treatment or a prescription, § 1-1003 requires a patient-appropriate clinical evaluation; synchronous or asynchronous methods may be used. Board guidance says online questionnaires alone are not enough and describes emergency protocols and patient-location checks. Make sure the policy covers the clinical services and follow-up your protocol actually uses.[^2][^3]

### Pain Prescribing Has an In-Person History Requirement

A Schedule II opiate for pain generally cannot be prescribed through telehealth unless the patient is in a health care facility, an emergency applies, or a bona fide ongoing relationship includes a previous in-person assessment by the practitioner or group practice. Identify controlled-substance services separately when you ask for coverage.[^2]

## Who Regulates Insurance in Maryland

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums when Maryland is the insured's home state; excludes risks of Maryland and its political subdivisions When Maryland is the insured's home state, the tax is 3% of gross premiums less returned premiums, except insurance of risks of the State or a political subdivision. For policies effective on or after July 21, 2011, Maryland taxes the entire premium and the broker must charge the tax in addition to premium.
