# Telehealth Insurance in Idaho

Idaho generally requires a provider delivering virtual care to hold a license from the applicable board, but §54-5713 lists limited exceptions for certain out-of-state providers, including continuity follow-up, credentialed facility work, disaster care, and consultation or referral. Providers using an exception consent to Idaho professional rules, the state standard of care, and Idaho jurisdiction. That legal consent is not proof that a liability policy follows them into Idaho.[^2][^1]

## What to Watch for in Idaho

### Out-Of-State Exceptions Are Specific

Section 54-5713 lists six circumstances for an otherwise licensed out-of-state provider to furnish Idaho virtual care without an Idaho license; the routes include continuity care, credentialed Idaho facility work, disaster follow-up, preparation for an in-person visit, and consultation or referral. Ask the broker to match each clinician’s services and entity to the route actually used and to confirm Idaho is included in the policy’s covered territory.[^2]

### Idaho Law Applies Under The Exception

A provider using a §54-5713 exception consents to applicable Idaho professional laws and rules, Idaho courts, and the licensing board’s complaint and disciplinary process. Ask who the policy insures if a claim names the clinician, employer, or contracting entity in Idaho; the statute itself does not answer policy response.[^2]

### Team And Call-Coverage Routes Differ

Idaho permits virtual care when the clinician has an established patient relationship, the patient has a relationship with another provider in the same group, or the clinician covers calls for a provider with an established relationship; the relationship can be formed through virtual care if the Idaho standard of care is met. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule. Surplus-lines policies do not receive Idaho guaranty-association protection.[^5][^6][^8]
